Holding 1,350 billion from Ms. Truong My Lan, how did Truong Hue Van overcome the consequences?

On the afternoon of March 21, the trial of defendant Truong My Lan (68 years old, Chairman of the Board of Directors of Van Thinh Phat Group) and 85 accomplices continued the arguments of the lawyers and the self-defense of the defendants.

During the morning trial on March 21, defendant Truong My Lan asked to transfer the amount of 1,350 billion VND to Truong Hue Van (Ms. Lan's nephew) to overcome the consequences. During the investigation phase, defendant Van recovered 1 billion VND.

Lawyer Chu Thi Trang Van (defending defendant Truong Hue Van) asked the Procuracy and the jury to note this new detail for her client. According to her, this is an "extremely important" episode. Because, if the jury agrees, the consequences of defendant Van's wrongdoing will have been completely overcome.

Defending defendant Van, the lawyer did not argue the crime, but asked the jury to reconsider the proposed sentence for the defendant. She believes that 19-20 years in prison for property embezzlement is too harsh for Van.

According to the lawyer, it is necessary to clearly differentiate the roles and responsibilities of the defendant. Defendant Van's defense attorney said his client completely trusted defendant Truong My Lan, was raised by defendant Truong My Lan since childhood, called defendant Lan his mother, so he was always obedient and completely dependent.

From there, the lawyer asked the jury to consider comprehensively so that his client would receive the most lenient and reduced sentence possible.

The case file shows that defendant Truong Hue Van directed his subordinates to establish and use 52 "ghost" companies and 4 real operating companies to create 155 loans at SCB bank to help Ms. Truong My. Lan appropriated the amount of 1,088 billion VND and caused damage of 25.2 billion VND.

In this case, one of the accomplices identified as helping Ms. Truong My Lan "gut" SCB was defendant Duong Tan Truoc (General Director of Tuong Viet Company).

According to the indictment, defendant Truong agreed with Truong My Lan to use legal entities of the Tuong Viet Company group, coordinate with SCB Bank officials, create false loan documents, and withdraw money from SCB to use. Duong Tan helped Truong My Lan appropriate 4,752 billion VND, causing a loss of 605 billion VND.

Mr. Truoc was given 1,498 billion VND by Ms. Lan to use for personal purposes. In addition, Duong Tan Truoc also received more than 2,204 billion VND from Ms. Lan.

After the case was prosecuted, the defendant overcame the consequences and paid SCB more than 813 billion VND to settle the loans of the Tuong Viet Company group.

With the above behavior, in the impeachment part, the prosecution requested the jury to sentence defendant Prior to 15-16 years in prison for property embezzlement.

Defending Mr. Duong Tan Truoc, lawyers Nguyen Van Quynh and Hoang Thi Thu said that because of the civil relationship between their client and Ms. Truong My Lan, a number of loans were created at SCB.

Lawyers said that defendant Truong sincerely confessed, repented, and actively cooperated with the investigation agency in the process of resolving the case; clearly aware of the violation, voluntarily cooperated with the family to use all assets to overcome the consequences of the case...

According to the lawyer, in the case, defendant Truong was determined to be an insignificant helper, so he asked the court to consider granting his client a special level of leniency that demonstrates the humaneness of the law.

Defending himself, defendant Duong Tan Truoc agreed with his lawyer's views. Besides, the defendant said his loans allegedly caused losses of more than 6,000 billion. His account is frozen, his distrained assets are surplus to overcome the consequences.

Specifically, in Mr. Truoc's frozen accounts, there were more than 2,000 billion VND in both principal and interest, a series of real estate, and more than 813 billion in remedial payments.
