In 2022, Ms. Van was one of the defendants charged with "Abusing democratic freedoms to infringe upon the interests of the State, the legitimate rights and interests of organizations and individuals". Ms. Van was prosecuted by the Long An Provincial Police Department and at the same time issued a wanted notice for fleeing her place of residence.

A few months later, Ms. Van contacted her lawyer with the desire to surrender. The defendant was then released on bail, living in Lap Thanh hamlet to assist in the investigation, complying with preventive measures prohibiting her from leaving her place of residence. At that time, Ms. Van was diagnosed with terminal cancer and was in very poor health.
