March 5, TAND HCMC. HCMC opened a preliminary hearing of the case that occurred at Van Thinh Phat Group, SCB Bank and related units. The trial is scheduled to run from March 5 to April 29.

Early in the morning, security forces guarding the court were present, and court security was tightened. Around 7 a.m., the motorcade carrying defendant Truong My Lan and 80 other defendants arrived in court.

Truong My Lan and 85 other defendants will be put on trial for crimes: Embezzlement of property, giving bribes, accepting bribes; abusing their positions and powers in the performance of official duties; lack of accountability has serious consequences; abuse of trust and misappropriation of assets; violating regulations on banking activities and other activities related to banking activities and violating regulations on lending in the operation of credit institutions...

In particular, defendant Truong My Lan was prosecuted and tried on three counts of embezzlement of property; giving bribes; violation of regulations on lending in the operation of credit institutions.

The trial was presided over by criminal court chief Pham Luong Toan. The Supreme People's Committee assigns 10 prosecutors from the Supreme People's Republic and the HCMC People's Committee to hold the right to prosecute in court.

Nearly 200 lawyers participated in defending the accused and protecting the legitimate rights and interests of related parties. Ms. Truong My Lan alone has 5 defense lawyers.

At 8:25 a.m., the presiding judge, Mr. Pham Luong Toan, announced the decision of the trial. At 8:45 a.m., defendant Truong My Lan was the first person on the podium to answer the council.

The presiding officer said that before the trial took place, he received a notification from the detention center about Ms. Truong My Lan's health situation. The presiding officer asked if the defendant's current health warranted participation in the trial, and in response to the trial, defendant Lan affirmed that he was healthy enough.

Answering about her identity, Lan said that she is ethnic Chinese, Vietnamese nationality, born in Ho Chi Minh City and permanently resides in District 1, (HCMC). Regarding education, this defendant testified that he finished grade 12, worked as the Chairman of Van Thinh Phat Group, had a husband named defendant Chu Lap Co and 2 children.

Ms. Truong My Lan testified that she had no criminal record; arrested at approximately 8:30 p.m. on Oct. 6, 2022 while on the road. For this part, the council said it would re-examine due to the record showing arrest on October 8, 2022.

The defendants present in court this morning also include Mr. Chu Nap Kee Eric (aka Chu Lap Co, Hong Kong businessman) accused of helping his wife "gut" SCB, causing losses of more than VND 9,116 billion. The defendant Truong Hue Van (Ms. Lan's nephew, 36 years old, General Director of Van Thinh Phat Group) was identified for his role in actively helping Ms. Lan, causing losses of nearly VND 1,100 billion.

Defendant Truong Hue Van was born in Ho Chi Minh City, resides in District 1, works as General Director of Windor Real Estate Management Company, has a husband and 2 children.

VTV quoted the indictment of the Supreme People's Committee as saying that the defendant Truong My Lan, Chairman of Van Thinh Phat Group, built a Van Thinh Phat ecosystem consisting of about 1,000 subsidiaries and affiliated companies assigned to relatives and family members of the defendant to hold and operate, management of subsidiaries and affiliated companies.

Although the defendant Truong My Lan does not hold a position at SCB Bank, he is the main shareholder here, from 85% to 91.5% of the shares. Defendant Truong My Lan and his accomplices made false loan documents to withdraw money from SCB to use for their personal needs.

From October 9, 2018 to October 7, 2022, defendant Truong My Lan directed to make 916 loan applications, misappropriating more than VND 304,000 billion from SCB. This amount so far the bank has not been able to pay and also incurred interest of more than VND 129,372 billion.

Defendant Truong My Lan was also tried for bribery for bribing the inspection team of the State Bank to hide and cover up the wrongdoings of the defendant and SCB, facilitating SCB's restructuring.
