Procuratorate: Truong My Lan did not lend SCB assets, but considered them to be a place to keep money

VKS said that Ms. Truong My Lan made false statements, in fact, Truong My Lan considered SCB as a financial instrument, a place to keep money, whenever she needed money, Ms. Lan directed other defendants to withdraw money.

On April 1, the trial of defendant Truong My Lan (68 years old, Chairman of Van Thinh Phat Group) and 85 other defendants continued the argument with the content of the HCMC Institute of Civil Engineering. VKS refuted, saying that "this is just a (untrue) testimony." Documents in the dossier on documents of withdrawal, payment, reports, submissions of SCB on 5 restructuring plans, approval documents of the SBV... there are sufficient grounds to determine that Ms. Lan did not lend assets to SCB but used the trick of putting assets in to create new loans and repay old loans of the defendant herself and related companies at the banks from before the consolidation.

According to the representative of the procuracy, a lot of assets put in by Van Thinh Phat group were not enough to secure, so the defendant Truong My Lan colluded with the defendants in the valuation group, raised the value to validate the dossier, and withdrew money from SCB with especially large amounts.

The lawyer said that the defendant was only a sponsor of the bank, borrowed relatives, mobilized partners from abroad to transfer money, Ms. Truong My Lan said that the investigating agency could not prove that the defendant used the money withdrawn from SCB to buy real estate.

In this regard, the procuratorate held that the accused did not admit to the offence, but rather lent the passbook to relatives as incorrect.

The procuratorate gave many examples of Ms. Lan giving unqualified assets to secure the loan, withdrawing, swapping collaterals, making 'short' loan documents, including Ms. Lan's promise to pay Mr. Yang Xun VND 1,500 billion, but asked Mr. Yang Jin Before to open a short loan to withdraw money from SCB, this is an act of misappropriating SCB's money.

In addition, the defendants, who are SCB leaders, also assert that defendant Lan never lent SCB property, but they also stated very clearly what properties the defendant bought and where.

In addition, during the interrogation and self-defense, the defendant Truong My Lan said that he did not misappropriate money from Saigon Commercial Joint Stock Bank (SCB), but gave assets including real estate, money transferred from abroad, the defendant's family members and relatives lent the defendant passbooks for SCB to restructure; The prosecution did not prove that the accused purchased any real estate but attributed in the indictment the use of misappropriated money from SCB to purchase the project and real estate of SCB.

As a result of the verification investigation, the Ministry of Public Security Investment Agency disclosed 1,169 assets related to Truong My Lan. These assets were admitted by Truong My Lan to the defendant or related to the defendant, asking or hiring people in his name; must be handed over to defendant Dang Phuong Hoai Tam and other subjects for monitoring.

Of these 1,169 properties, only about 60 were purchased by the defendant before 2012, while the remaining 1,109 of the 1,169 properties purchased by the defendant after 2012 (94.8%). The timing of the formation of the above properties coincides with the time when the accused commits the offence.

"This is a condition, method and trick for the defendant to take advantage of misappropriating money at SCB," the VKS representative said.

VKS assessed that most of the defendants were sincere and repentant, but some lawyers in the argument were not really serious, the arguments made did not closely follow the development of the trial, affecting the rights of the defendants. Some lawyers use judgmental language, lacking grounds for VKS's assessment.
