The case of the adopted son of Meritorious Artist Hoai Linh suing his ex-boyfriend over a house dispute, the court announced the verdict

On June 11, after many days of trial and deliberation, the People's Court of Ho Chi Minh City announced the appeal verdict on the property dispute between the plaintiff Pham Hoai Linh (singer Anh Linh, adopted son of artist Hoai Linh) and the defendant Mr. NNP.

The appellate court partially accepted the plaintiff's appeal, acknowledged the defendant's voluntary move out of the apartment building to hand over the apartment to the plaintiff, and the defendant must pay the plaintiff the debt.

The appellate panel also ordered the plaintiff to pay the defendant the principal amount that the defendant had paid to purchase the apartment, and the price difference corresponding to the defendant's contribution to the value of the apartment.

The appellate panel ordered both the plaintiff and the defendant to pay the court fees as prescribed for the part of the request that was not accepted.

According to the lawsuit, Ms. Linh and Mr. P. contributed to buy an apartment in District 7, Ho Chi Minh City. After that, the two had a conflict, Ms. Linh filed a lawsuit, demanding that Mr. P. move out and return the apartment to her along with the amount of more than 1.2 billion VND he borrowed, forcing Mr. P. to compensate Ms. Linh 360 million VND for having to rent another place to live. Ms. Linh will return the original amount of 93 million VND that Mr. P. paid to the bank.

Mr. P. agreed to return the apartment on the condition that Ms. Linh had to pay him the portion he contributed to buy the apartment, which was 393 million VND. Mr. P. did not agree to pay 360 million VND. Regarding the loan request (more than 1.2 billion VND), Mr. P. also did not agree to pay.

Mr. P. filed a counterclaim, requesting the court to divide the common property, the apartment, based on the value of his contribution, which was assessed at over VND 2.1 billion. Mr. P. agreed to give Ms. Linh the apartment and requested Ms. Linh to return to him the VND 410 million he contributed to buy the apartment.

On November 15, 2024, District 7 People's Court (HCMC) held a first-instance trial and accepted Ms. Linh's lawsuit request to force Mr. P. to return the apartment to Ms. Linh, and did not accept the request to force Mr. P. to pay back the plaintiff for renting another apartment to live in.

The first instance court also ordered the plaintiff to pay the defendant 353 million VND.

After the first instance judgment, District 7 People's Procuracy appealed, and both the plaintiff and the defendant appealed.

On May 20, Ho Chi Minh City People's Court opened the appeal hearing and now announced the verdict as stated above.
