Lawyer Tran Minh Hung (Head of the Family Law Office, Ho Chi Minh City Bar Association) sees from a social perspective that this is a very alarming incident. Commenting from a legal perspective, Mr. Hung said that the act of secretly filming can come from many different motives such as to satisfy his own perverted and deviant interests; defame, insult the honor and dignity of others or simply "get views" or "get likes" online. However, regardless of the purpose, this is considered a form of harassment and serious harm to the legitimate rights and interests of others protected by law.

Therefore, depending on the purpose, nature and extent of the violation, the person committing the act may be administratively handled or considered for criminal liability according to the provisions of law.

Citing the provisions in Clause 3, Article 102 of Decree No. 15/2020/ND-CP of the Government, the lawyer said that people who collect, process and use information of other organizations and individuals without Without consent or for the wrong purpose according to the law, you may face a fine of 10-20 million VND.

In addition, if the behavior is determined to be in the group of harassment, the violator may also be fined 5-8 million VND as prescribed in Clause 5, Article 7 of Decree 144/2021/ND-CP of the Government. government.

Also following the incident, lawyer Truong Van Tuan (Head of Trang Saigon Law Office, Ho Chi Minh City Bar Association) acknowledged that according to Article 32 of the 2015 Civil Code, every individual has the right to their image. The use of an individual's image must be approved by that person. The act of filming or recording other people without their permission is considered a violation of the law, a violation of social ethics and will be subject to sanctions commensurate with the severity of the violation.

Having a similar opinion to lawyer Hung, lawyer Tuan said that the application of sanctions for secretly filming behavior of young men will be based on the provisions of Decree No. 144/2021/ND-CP and Decree No. 15/2020/ND-CP of the Government.

In addition, Mr. Tuan emphasized that from a criminal perspective, if the person filming secretly aims to humiliate, seriously offend dignity, honor, or reduce the reputation of the individual, they can be prosecuted. criminal offense of humiliating others according to Article 155 of the 2015 Penal Code.

In addition, if the act is for the purpose of storing, circulating, exchanging, transporting, buying and selling to disseminate secretly recorded images and videos with sensitive content, the person committing the act may be prosecuted. criminal offense of spreading bad cultural products as prescribed in Article 326 of the 2015 Penal Code.

From a civil perspective, the person committing the violation must also compensate for all damages caused to the victim (if any) according to the provisions of the current Civil Code.
