After nearly 1 month of trial and lengthy deliberation, the High Court in Ho Chi Minh City yesterday sentenced the defendant Truong My Lan, former Chairman of Van Thinh Phat Group, and 47 accomplices.

According to VietNamNet, regarding the role of the defendant Truong My Lan in the case, the Board of Directors said that the act was particularly serious, infringing on the bank's monetary management policy, losing the trust of customers depositing money at SCB.

The defendant committed 3 crimes at the same time, causing bad public opinion. The fact that the first-instance level sentenced the defendant to death for the crime of "Embezzlement of assets", 20 years in prison for the crime of "Giving bribes", and 20 years in prison for the crime of "Violating regulations on lending in the operation of credit institutions" is the right person, the right crime, and not wrong.

At the appellate hearing, the defendant Truong My Lan and the defendants, individuals and legal entities paid more money to remedy the consequences, the defendant Lan also voluntarily put many assets into the remedy. However, according to the Judicial Council, these assets are not enough legal grounds to determine their value, thereby not enough basis to determine that the defendant has overcome 3/4 of the consequences to apply penalty mitigation for the crime of "Embezzlement of assets".

During the trial, the defendant also had a profound change in cognition, repentance and many other extenuating circumstances, so the Board of Directors accepted the view of VKS to mitigate part of the penalty for the defendant for the crime of "Violation of regulations on lending in the operation of credit institutions".

Therefore, the court accepted the appeal to reduce the sentence from 20 years in prison to 16 years in prison for this crime, but still maintained the sentence for the other 2 crimes. Summing up the punishment, the jury forced the defendant Truong My Lan to serve the death penalty.

In addition, the court also rejected the defendant's appeal for exemption of more than VND 673 billion in court fees; reimbursement to SCB Bank of VND 673,000 billion; assigned SCB to coordinate with Judgment Enforcement to handle 1,121 collateral codes for 1,243 loans; continue to distrain with 658 asset codes owned by Van Thinh Phat Group; continue to distrain the real estate and yacht of the defendant Lan.

Although the death sentence was upheld, the defendant Lan appeared very calm. When hearing the presiding judge announce that he has the right to send an application for amnesty to the President within 7 days when the judgment takes effect and if he actively cooperates and overcomes 3/4 of the consequences, the penalty will be transferred to life imprisonment, Ms. Lan continuously bowed her head and thanked the Council.

Citing news from VOV, for the defendant Do Thi Nhan (former Director of the Inspection and Supervision Department of Bank II, State Bank), the Appellate Tribunal determined that the nature and extent of defendant Nhan's behavior were particularly serious, infringing on the prestige of the Party and the State, affecting social security.

Although the Court of Appeal noted that the defendant Nhan had many new mitigating circumstances, such as: his family had meritorious services to the revolution, handed over the entire amount of bribes of 5.2 million USD and paid an additional 1 billion VND to overcome the consequences of the case.

However, the appeal for penalty reduction of the defendant Nhan was not accepted by the Judicial Council and was sentenced to life imprisonment in the first instance.

In addition, the Appellate Tribunal also considered accepting the appeal for penalty relief of the defendants: Truong Hue Van, Chu Lap Co is the granddaughter and husband of Ms. Truong My Lan.

In which, the defendant Chu Lap Co was sentenced by the appellate court from 9 years in prison to 7 years in prison; defendant Truong Hue Van was sentenced from 17 years in prison to 13 years in prison for embezzlement of property.

Recognizing that Nguyen Cao Tri had overcome all the consequences of the case, in the process of working with excellent achievements, and was in poor health, the Judicial Council accepted the appeal, reducing the defendant's prison sentence from 8 years to 6 years.
