Truong My Lan wrote a petition to reduce nearly 700 billion in court fees in phase 1.

It is expected that from November 4 to November 25, the High People's Court in Ho Chi Minh City will hear the first phase of the appeal of the Van Thinh Phat case to consider the appeal of defendant Truong My Lan, 47 other defendants, victims and a number of people with related rights and obligations.

Previously, on April 11, 2024, the Ho Chi Minh City People's Court held a first-instance trial and sentenced defendant Truong My Lan to the highest combined penalty for three crimes: violating regulations on lending in the operations of credit institutions, embezzlement of property, and bribery. The remaining 85 defendants received sentences ranging from 3 years in prison with a suspended sentence to life in prison for one or more of the above crimes.

The panel of judges ordered defendant Truong My Lan to compensate SCB for the remaining outstanding debt of 1,243 loans as of October 17, 2022, equivalent to VND 673,800 billion.

Regarding court fees, the court of first instance ordered defendant Truong My Lan to pay more than 673 billion VND in first instance civil court fees.

After the first instance verdict, in addition to filing an appeal against the entire verdict, Ms. Truong My Lan also filed a request to waive more than 673 billion VND in court fees.

Regarding the appeal, 47 defendants (including Truong My Lan's husband and nephew, Chu Lap Co, Truong Hue Van; Tran Thi My Dung (former Deputy General Director of SCB), Truong Khanh Hoang (former Acting General Director of SCB))... all appealed for a reduced sentence, asked for a suspended sentence...

Previously, before the appeal hearing, a number of defendants withdrew their appeals and accepted their sentences, including Mr. Nguyen Van Hung (former Deputy Chief Inspector of the State Bank). This person was accused of making the inspection decision, being responsible for directing and supervising the inspection activities of the Inspection Team at SCB Bank; receiving reports from the Inspection Team and reporting to the leaders of the State Bank to report to the Prime Minister on the inspection results.

Mr. Nguyen Van Hung was accused of receiving a total of 390,000 USD from SCB many times through Dinh Van Thanh (Chairman of the Board of Directors of SCB) and Vo Tan Hoang Van (General Director of SCB) to cover up and conceal violations at this bank.

For the above actions, Mr. Hung was sentenced by the People's Court of Ho Chi Minh City to 11 years in prison for the crime of "Abusing position and power in performing official duties".

Believing the verdict was harsh, Mr. Hung appealed for a lighter sentence. He later withdrew his appeal and accepted the 11-year prison sentence.

In addition to Mr. Hung, three other defendants withdrew their appeals before the appeal trial.

The victim, SCB Bank, appealed and requested to review the entire content of the first instance judgment regarding civil liability, handling of evidence, handling of seized and frozen assets...

The person with related rights and obligations, Quoc Cuong Gia Lai Joint Stock Company, appealed, requesting consideration of the company only having to pay an amount equivalent to more than VND 1,441.1 billion to defendant Lan, deducting VND 130 billion that the company had transferred to Tan Viet Securities Joint Stock Company; requesting consideration of returning 6 land use right certificates.

T&H Ha Long Joint Stock Company and Au Lac Quang Ninh Company appealed to consider canceling the signed framework agreements, releasing the seizure, returning the shares and real estate of the company that are being seized after returning the amount of more than 6,095 billion VND.

Previously, according to the first instance court, out of 1,237 real estates seized, there were 6 real estates belonging to Quoc Cuong Gia Lai Investment Joint Stock Company. The panel of judges determined that Quoc Cuong Gia Lai Company had received VND2,883 billion from defendant Lan.

Therefore, to ensure the civil obligations in this case of defendant Lan, the panel of judges declared that when Quoc Cuong Gia Lai Company returns the entire amount of 2,882.8 billion VND received from defendant Lan, the seizure of those 6 real estates will be removed.

The panel also ordered T&H Ha Long Company and Au Lac Quang Ninh Company to pay back more than 6,095 billion VND... to ensure defendant Lan's obligations in the entire case.
