Recently, the High People's Court said it would consider the appeal of Ms. Tran Thi Hien, the mother of the victim of the "chicken delivery girl" case, after 6 months when the Supreme People's Court annulled the appeal verdict.
Ms. Hien, 48 years old, was prosecuted for illegally buying and selling bran. In her appeal, Ms. Hien said that the group of people who arrested and attacked her daughter falsely accused the defendant of buying and selling banned substances.
Meanwhile, defendants such as Vi Van Toan, Luong Van Hung and Bui Van Cong did not appeal. All three were sentenced to death on three charges in the murder case of Ms. Hien's daughter on Tet 30, 2019.
The remaining defendant, Vi Thi Thu (42 years old), Toan's wife, is appealing with Ms. Hien.
According to the indictment, the case was discovered from Cong's complaint in mid-March 2019 while he was in detention in the case of Ms. Hien's daughter. Publicly in mid-2017, a woman introduced herself as Hien, in Thanh Hung commune (Dien Bien district) and ordered four cakes of banned substances for 160 million VND per cake. Cong then placed an order from Thu but she only had two cakes.
At the end of May 2017, Cong and Ms. Hien traded two wheels of banned substances at the cemetery area of Thanh Hung commune. Ms. Hien just paid 290 million VND and owes 30 million.
In the first instance session opened in November 2019 at the People's Court of Dien Bien province, Toan, Cong, and Hung confessed to all acts of buying and selling banned substances. Ms. Hien and Thu pleaded not guilty.
At the previous appeal court, defendant Hien could not hold back her tears and maintained her previous testimony, claiming that she was unjust.
Ms. Hien said that the court only relied on the testimony of a group of drug addicts, Cong, Toan, and Hung, to convict her, which was unfounded. "If I buy and sell banned substances with Cong, I will definitely have to contact him by phone. So let's find those phone numbers to prove whether I contacted Cong or not," Ms. Hien.
However, the first instance judgment determined that in May 2017, for "profit", defendant Hien met Cong and said he wanted to buy 4 wheels of banned substances. Cong agreed and met Thu to place an order for 150 million VND per cake.
Thu went to the Vietnam - Laos border to look for banned substances but could only buy two cakes for a total of 180 million VND. Thu brought the goods home and hid them at home, telling her husband, Toan, to take care of them. At the end of May 2017, Thu sold two wheels of banned substances to Cong for 300 million VND.
The People's Court of Dien Bien province sentenced defendants Hien and Cong to 20 years in prison each; Hung and Thu received life sentences for illegally trading in banned substances. Full life sentence for two counts of Illegally Trading in Controlled Substances and Possession of Illegally Using Controlled Substances.
According to Dien Bien Police, the fact that Ms. Hien owed Cong 30 million VND and Math 300 million VND was the reason her daughter was kidnapped and died in early February 2019. In this case, Toan, Cong, and Hung were the main culprits, assisted by 6 accomplices. Of the 9 people brought to trial, 6 received the death penalty.
After the first instance trial of the case of buying and selling banned substances, the two defendants Thu and Hien pleaded not guilty. During the appeal session in May 2022, the High People's Court in Hanoi said that many details in the case were still contradictory, some details could not be clarified immediately at the trial.
The Court of Appeal annulled part of the first instance judgment related to defendant Hien for re-investigation and trial.
Defendant Thu also appealed and claimed innocence. However, the appellate court said that there was no basis to accept it, so it decided to reject the appeal and at the same time maintain the sentence in Thu's first instance judgment.
In September 2023, the Council of Judges of the Supreme People's Court issued a decision to cassation of the case and annulled the appeal judgment of the High People's Court in Hanoi, and requested a retrial.
It is expected that on March 19, in Dien Bien, the High People's Court will open an appeal session.
