The police of Quang Tri province confirmed that the unit has arrested Nguyen Quoc Quan (32 years old, nicknamed Quan "Idol"; residing in Khe Sanh town, Huong Hoa district) and several others to conduct an investigation into the illegal arrest of people.
Specifically, on the morning of August 25, after arresting Quan "Idol", the police force of Quang Tri province and the Mobile Police force, the police of Huong Hoa district also blocked many roads for the purpose of searching the houses and business places of the subjects.
By the evening of the same day, the search was still urgently completed by the authorities.
In addition to Quan "Idol", the police also arrested other subjects including: Hoang Thai Manh (31 years old, residing in Khe Sanh town, Huong Hoa district) and Nguyen Phi Cuong (33 years old, residing in Tan Hop commune, Huong Hoa district) for their involvement in the above act.
Previously, Quang Tri police received a criminal complaint for illegally arresting people. After verifying and collecting relevant evidence documents, the police of Quang Tri province executed an emergency detention order for Quan "Idol" and his subjects.
It is known that Quan "Idol" is a "senior" with blood in Quang Tri province. Although still young, this subject already owns many luxury cars and beautiful number plates.
Currently, the incident is still being actively investigated by the authorities of Quang Tri province.
Over the past time, in order to prevent acts of profiteering, create equality and transparency in the issuance and use of license plates, new regulations have been issued.
According to Circular 24/2023/TT-BCA regulating the issuance and revocation of registration and license plates of motor vehicles issued by the Minister of Public Security. From August 15, license plates of cars and motorcycles will be issued and managed according to the vehicle owner's identification code. Therefore, car owners who transfer vehicle ownership are required to carry out procedures for revoking registration and license plates, if they fail to do so, they will be fined according to regulations.
Failure to carry out procedures for revocation of vehicle registration certificates and license plates after transferring ownership within how long is the penalty?
Accordingly, when buying a car, giving or giving gifts, people must carry out procedures for registration to the vehicle name (to change the vehicle owner's name in the Vehicle Registration Certificate to his/her own) within 30 days from the time the vehicle is transferred.
Specifically, in Clause 4 Article 6 of Circular 24/2023/TT-BCA, there are regulations on the responsibilities of vehicle owners when transferring vehicle ownership (selling cars) as follows:
4. When selling, donating, inheriting, exchanging, contributing capital, allocating or transferring vehicles (hereinafter collectively referred to as transfer of vehicle ownership):
a) The vehicle owner must retain the vehicle registration certificate and license plate number (not handed over to the organization or individual receiving the transfer of vehicle ownership) and submit to the vehicle registration agency the vehicle registration certificate and license plate for revocation procedures; in case of transfer of ownership of the vehicle together with the auction-winning license plate, the vehicle owner shall submit to the vehicle registration authority the vehicle registration certificate for revocation procedures;
b) Within 30 days from the date of issuance of documents for transfer of vehicle ownership, the vehicle owner must carry out procedures for revocation; In case after the above time limit, the vehicle owner fails to carry out procedures for revocation or hand over the vehicle registration certificate or license plate to the organization or individual receiving the transfer of vehicle ownership to carry out the recall procedures, before settling, the vehicle registration agency shall issue a decision to impose a penalty on the vehicle owner for the act of failing to carry out the recall procedures as prescribed;
In case the vehicle owner fails to carry out recovery procedures after transferring ownership of the vehicle, he shall be responsible before law for violations related to that vehicle;
c) After the vehicle owner carries out the withdrawal procedures, the organization or individual receiving the transfer of ownership rights shall carry out registration procedures to the vehicle name according to regulations.
Thus, according to the above-mentioned regulations, within 30 days from the date of making documents for transfer of vehicle ownership, the vehicle owner must retain the vehicle registration certificate, license plate number and submit it to the vehicle registration authority for procedures for revocation or delivery of vehicle registration certificates and license plates to organizations, The individual receiving the transfer of ownership of the vehicle shall carry out revocation procedures. After this 30-day period, if the car owner fails to carry out the recall procedures, he will be fined. At the same time, they must be responsible before law for violations related to that vehicle.
Penalties for vehicle owners "Failure to comply with the revocation of the vehicle registration certificate; license plate" shall be applied in accordance with the provisions of Decree No. 100/2019/ND-CP of the Government. Specifically, for motorcycles, motorcycles will be fined from 800,000 to 2,000,000 for individuals; 1,600,000 to 4,000,000 for organizations (Point e, Clause 5, Article 30, Decree 100). For cars, violations of this violation will be fined from 2,000,000 - 4,000,000 VND (for individuals), from 4,000,000 - 8,000,000 VND for organizations (Point c, Clause 7, Article 30, Decree 100).
