Ms. Dang Thi Han Ni was officially removed from the Ho Chi Minh City Bar Association

On May 15, lawyer Nguyen Van Trung, Chairman of the Ho Chi Minh City Bar Association, confirmed with Nguoi Lao Dong Newspaper that the name of Ms. Dang Thi Han Ni (born 1977) was removed from the list of lawyers of the Association.

Accordingly, on May 14, the Board of Directors of the Ho Chi Minh City Bar Association issued a decision on disciplining lawyers against Ms. Dang Thi Han Ni. Ms. Han Ni's name was removed from the Ho Chi Minh City Bar Association.

This decision is based on Point a, Clause 3, Article 42 of the Charter of the Vietnam Bar Federation and Clause 6, Article 40 of Regulation 50/QD-HDLSTQ dated March 8, 2023 of the National Bar Council.

Ms. Han Ni was granted a law practice certificate No. 2944/TP/LS-CCHN issued by the Minister of Justice on August 8, 2006, and a Lawyer Card No. 4363/LS issued by the Vietnam Bar Federation on August 11. -November 2015).

The decision to remove her name takes effect from May 14 and Ms. Han Ni has the right to complain to the Standing Committee of the Vietnam Bar Federation within 15 days from the date of receiving the decision.

Previously, on March 1, in the first instance, the People's Court of Ho Chi Minh City sentenced defendant Dang Thi Han Ni to 1 year and 6 months in prison for "Abusing democratic freedoms to infringe on the interests of the State, legitimate rights and interests of organizations and individuals".

According to the first instance judgment, from September 2021 to February 2022, Han Ni used the Youtube and Facebook accounts "Journalist Han Ni" to post articles and organize many recording sessions with false content "in order to insulting the dignity, honor, and reputation of Ms. Nguyen Phuong Hang and Mr. Huynh Uy Dung"; violates the legitimate interests of Dai Nam Joint Stock Company and Hang Huu Charity Fund.

In particular, Han Ni used her Youtube account to broadcast a recording with the content "Does Ms. Hang have the right to squat under the law?", including 4 paragraphs containing statements about her personal secrets and private life. Ms. Hang and her husband, violating Article 17 of the Law on Cyber Security.

During the investigation, Han Ni claimed to have taken the above information "from official articles published about Ms. Hang, so we did not verify whether it was true or false." The reason for doing so was that Ms. Hang livestreamed with insulting words to the defendant.

And lawyer Tran Van Sy was accused of using the Youtube account "Lawyer Tran Van Sy" to post 8 videos: Dai Nam Joint Stock Company & anti-money laundering activities, Did the BD Provincial Government oppress Dai Nam Joint Stock Company's neck? like NPH, NPH used stimulants to scold artists, Dung Lo Voi failed completely... These contents were determined to be false, causing confusion in public opinion, violating rights and legitimate interests of Dai Nam Joint Stock Company; violated the honor, reputation, and personal dignity of Mr. Huynh Uy Dung; Seriously insulting the honor, dignity, and reputation of Ms. Nguyen Phuong Hang.

Mr. Sy stated that the reason for making the above videos was that Ms. Hang had made offensive statements about artists, the press, and had words that were contrary to good customs and traditions. He feels he "needs to have the responsibility to speak up" to limit Ms. Hang's negative influence. As for Mr. Dung, the defendant said that because he "often records with his wife"...

During the additional investigation, Ms. Hang and Mr. Dung each asked Han Ni and lawyer Sy to pay 300-500 billion VND in compensation but then withdrew the application. For a number of other Facebookers with similar behavior towards Ms. Hang, the investigation agency continues to coordinate with the Cyber Security and Crime Prevention Department using high technology of Ho Chi Minh City Police to verify and collect more information. documentary evidence, processed later.

Before being arrested in March 2022, Ms. Hang sent many complaints to Binh Duong Provincial Police and Ho Chi Minh City Police, claiming that journalist Han Ni "insulted, slandered" and attacked the Company's Hang Huu fund. Dai Nam Joint Stock Company. She asked the authorities to handle Han Ni; Forced to stop using her image without consent, and compensated for damages.

Meanwhile, Ms. Han Ni also sent a criminal complaint to the Ministry of Public Security, Ho Chi Minh City Police, and Binh Duong, claiming that Ms. Phuong Hang was slandered, humiliated, and insulted during the livestreams.

Regarding the case, defendant Tran Van Sy (former Chairman of the Vinh Long Provincial Bar Association) was sentenced to 2 years in prison. After the trial, Mr. Sy filed an appeal but Ms. Han Ni did not.
