Ms. Nguyen Phuong Hang (53 years old, General Director of Dai Nam Joint Stock Company) and her husband Huynh Uy Dung (62 years old, Chairman of Dai Nam Joint Stock Company) and Hang Huu Charity Foundation of Binh Duong province were summoned by the court as persons with related interests and obligations. However, all litigants have applied for hearing in absentia.

The general director of Dai Nam Joint Stock Company is serving a 3-year prison sentence for abusing the rights to freedom and democracy to infringe upon the interests of the State, the legitimate rights and interests of organizations and individuals, for insulting the honor and reputation of Han Ni journalists and many famous artists.

During the background check, defendant Sy said the record showing that he had 1 child was incomplete, he said he had 3 children. Defendant Han Ni appeared calm, answering loudly and clearly questions related to personal matters.

In the absence of Ms. Nguyen Phuong Hang and her wife, the court said that there was a testimony that did not affect the trial process, so the trial continued. Representatives of Ho Chi Minh City People's Committee began to announce indictments.

According to the indictment, Ms. Dang Thi Han Ni and Tran Van Sy abused democratic freedoms and conducted many livestreams in cyberspace in violation of Points a, b, Clause 3, Article 16; Point b, Clause 1, Article 17 of the 2018 Law on Cybersecurity (seriously offending the honor, prestige, dignity of others, false or fabricated information) and Point d, Clause 1, Article 5 of Decree No. 71/2013/ND-CP (giving information that distorts, slanders, insults the reputation of others).

At the investigating agency, Ms. Ni stated that the reason for the crime was that Ms. Nguyen Phuong Hang recorded a live stream on social media with insulting words about Ms. Ni.

This defendant testified that the above statements regarding personal information related to Ms. Hang's private life were based on part of the information and content in the official articles published about Ms. Nguyen Phuong Hang, so Ms. Ni did not verify herself, did not need to consult Ms. Hang and did not need the approval of the press agency.

The case file shows that, from September 2021 to February 2022, Tran Van Sy used the YouTube account "LS Tran Van Sy"; Dang Thi Han Ni used the YouTube and Facebook accounts "Han Ni Journalist" to post and organize many recording sessions broadcast on social networks with false content, in order to offend the dignity, honor and reputation of Mr. Huynh Uy Dung and his wife Nguyen Phuong Hang. This infringes upon the legitimate interests of Dai Nam Joint Stock Company (Binh Duong) and the Foundation eternal charity.
