According to the indictment, stemming from conflicts in livestreams of Ms. Nguyen Phuong Hang (born in 1971, General Director of Dai Nam Joint Stock Company, Binh Duong province), the two defendants took advantage of their positions as journalists and lawyers to collect information, edit content, record and take advantage of the cyberspace environment to post, play many videos with information belonging to Ms. Heng's personal secrets, family secrets and private life contrary to the law; information with fabricated contents, false, causing confusion among the people, insulting the honor and prestige of personal dignity Ms. Hang and her husband Mr. Huynh Uy Dung (born in 1961, Chairman of the Board of Directors of Dai Nam Joint Stock Company, Binh Duong province); infringe upon the legitimate rights and interests of Dai Nam Joint Stock Company and Hang Huu Charity Foundation (both of which Ms. Hang is the Director).

Specifically, from September 2021 to February 2022, defendant Dang Thi Han Ni used Youtube and Facebook accounts named "Journalist Han Ni" and defendant Tran Van Sy used a Youtube account named "LS Tran Van Sy" to organize many recording sessions broadcast on social networking sites with fabricated content, untrue information or unverified information, seriously offending the reputation and honor of individuals or organizations. Accordingly, the defendant Dang Thi Han Ni recorded and broadcast it online on September 3, 2021 with the title: "Does Ms. Hang have the right to squat above the law?" to counter the contents of Ms. Hang's incorrect statements about defendant Han Ni "blackmailing businesses", "being Mr. T.T.C's father" ...

Through the process of investigation and public questioning in court, the Labor Council considered that there were sufficient grounds to determine that the contents posted by defendants Han Ni and Tran Van Sy were offensive and false; confidential, private information, affecting Ms. Nguyen Phuong Hang and Mr. Huynh Uy Dung and Dai Nam Joint Stock Company.

"The defendants' acts adversely affect social order and safety, so serious punishment is needed to deter. The VKS indictment against the defendants is the right person, the right crime, not wrongful," it said.

However, the JSC also noted mitigating circumstances for the defendants such as first offense, sincere declaration, many contributions, good achievements, etc.

In their final words, both Ms. Han Ni and Mr. Sy expressed remorse, admitted their mistakes, and wished for the lightest possible sentence.

Based on the nature of the case and developments at the trial, aggravating and mitigating circumstances, the Social Security Council decided to sentence defendant Dang Thi Han Ni to 18 months in prison and Mr. Tran Van Sy to 2 years in prison for "Abusing the rights to freedom and democracy to infringe upon the interests of the State, legitimate rights and interests of organizations and individuals" according to Clause 2, Article 331 of the Penal Code.
