This morning (May 16), the People's Court of Dinh Quan district, Dong Nai province opened a trial for defendant Hoang Van Tinh (residing in Thua Thien Hue, driver of Thanh Buoi bus) for violating regulations. regulations on participating in road traffic and defendant Le Duong (Deputy Director of Thanh Buoi Co., Ltd.) on the charge of sending people who are not qualified to drive vehicles to participate in road traffic.

According to the indictment, although his Class E driver's license was revoked by the Traffic Police Department of Lam Dong Province (from August 5 to November 5, 2023), on the morning of September 30, 2023, Calculate still drives a passenger car of Thanh Buoi garage with license plate number 50F-004.83 running the Ho Chi Minh City - Lam Dong route.

At about 2:25 a.m. on September 30, 2023, because he did not keep a safe distance from the truck running in front, he collided with the rear of this vehicle. After the collision, Tinh turned the steering wheel, steered the car to the left and entered the road reserved for vehicles traveling in the opposite direction.

At this time, a passenger car (16-seat type) driven by Mr. Nguyen Van Canh, resident of Binh Thuan province, carrying 8 passengers traveling in the direction of Da Lat - Dau Giay, was hit by Tinh's car. hit hard on the side and pushed to the side of the road. The accident left five people dead and four seriously injured.

Defendant Le Duong was brought to trial for the crime of sending an unqualified person to drive a vehicle to participate in road traffic, according to Article 263 of the 2015 Penal Code (amended 2017).

Hoang Van Tinh was tried for violating regulations on road traffic participation.

At the trial, driver Hoang Van Tinh testified that before leaving, the company checked the driver's alcohol level with a meter but did not check the driver's license.

When asked about the positive alcohol test, Tinh declared that he did not drink alcohol before driving. However, after causing an accident, Tinh was worried so he went out to drink.

Tinh was then taken by the company car to the police station to surrender.

Defendant Le Duong is the youngest son of Mr. Le Duc Thanh, holding the position of deputy director of Thanh Buoi Company. At this bus station, Duong is the person with the authority to sign transport orders for passenger transport activities.

During the investigation of the case, the investigation agency determined that on September 30, 2023, Duong did not check his driver's license or measure his concentration as prescribed for Tinh. However, Duong still ordered Tinh to drive a passenger car from Ho Chi Minh City to Da Lat and caused a traffic accident.

After the traffic accident, Thanh Buoi Company compensated the victims' families nearly 2.7 billion VND and the two car owners 800 million VND.

The victims' families and legal representatives of the victims filed a petition to reduce the punishment for the defendants and did not request any further compensation.

According to the indictment, Mr. Nguyen Ho Huu Tung (43 years old, residing in Ho Chi Minh City) is the head of two human resources and transportation management departments of Thanh Buoi Company. Mr. Tung is directly in charge of transportation business activities, manages the transportation operations department, and is responsible to the company director for all operations of the transportation operations department.

And Ms. Nguyen Thi Anh Tram (40 years old, living in Lam Dong) is the shift leader of the passenger reception department (shift leader 2), and is responsible for knowing whether the driver meets the necessary conditions for a driver's license. alcohol content or not... before delivering the car.

During the process of performing their assigned work, Mr. Tung and Ms. Tram did not check the driver's license, did not measure the alcohol concentration of driver Hoang Van Tinh but still delivered the car.

However, there is not enough evidence to determine the role of Mr. Tung and Ms. Tram's accomplices in the case. The investigation agency continues to collect documents and evidence to clarify and handle them later.
