The case of a father 'punishing' a driver who harmed his child in Vinh Long: the collision report was revealed, the complaint to the prosecutor was rejected?

Before taking action against the person Mr. Phuc believed caused his daughter's tragic passing, more than 2 months ago, he sent a complaint to the People's Procuracy of Tra On district and the People's Procuracy of Vinh Long province.

According to the source of the incident, on September 4, 2024, female student NNBT (born in 2010) passed away on the way to school on the first day, after colliding with a truck. The incident attracted great attention at that time. Recently, public opinion was shocked when the father of female student T went to the house of the truck driver who had collided with his daughter, to harm the other party and then end his own life. Mr. Phuc (the female student's father) did not survive. Meanwhile, the driver is currently out of danger and is still in the hospital.

According to information from Can Tho Central General Hospital, patient T. is currently unconscious and has not recovered, and his vital signs are stable. According to doctors, the bullet's spin caused brain damage, breaking many pieces of the frontal bone, entering the occipital region, etc. However, the bullet has been removed, and hopefully the brain will recover soon.

According to the Conclusion of Cause and Fault in the Traffic Collision, the Traffic Police Team of Tra On District Police, Vinh Long Province determined that the driver of the truck with license plate 84C-102.77, Mr. Nguyen Van Bao T., had committed the act of "overtaking without ensuring safety". On December 26, 2024, the Investigation Police Agency of Tra On District Police, Vinh Long Province issued a Decision Not to prosecute the criminal case for the following reasons: The person who committed the socially dangerous act has passed away.

On January 17, 2025, the Deputy Chief of the People's Procuracy of Tra On District, Vinh Long Province signed a Decision to cancel the Decision not to prosecute the case of the Tra On District Police Investigation Agency. On January 23, 2025, Lieutenant Colonel Nguyen Hoang Van, Head of the Tra On District Police Investigation Agency, signed a document announcing that this agency did not prosecute the criminal case for the reason: There was no crime.

Regarding the accident that caused Mr. Phuc's daughter to pass away, many people expressed: "I hope the authorities will reopen the case... Overtaking without ensuring safety is wrong. If Mr. T. had not overtaken recklessly, would Tr. have been injured? The case file needs to be reviewed to restore justice to the child and her family...".

Lawyer Le Ngoc Luan (Ho Chi Minh City Bar Association) stated that according to the conclusion of the authorities, the collision was a mixed fault. Both the deceased female student and the driver were at fault, but Tr.’s fault was not a factor in deciding whether to prosecute the case or not. The fault of the driver T. caused serious consequences.

"According to Article 260 of the 2015 Penal Code, amended and supplemented in 2017, driver T.'s fault caused serious consequences when he encroached on the lane and caused a collision. This factor is sufficient and necessary to initiate a criminal case. Tr.'s fault, if any, is only a factor to consider in mitigating the penalty for the truck driver...", lawyer Luan analyzed.

According to Lawyer Do Ngoc Thanh, Chairman of the Ho Chi Minh City Bar Association and the Association for the Protection of Children’s Rights, the passing of the female student has left a great loss for her family and the community. But what makes the pain even deeper is that when the child, the deceased victim, was identified as the person who committed the dangerous act to society, she passed away.

Lawyer Thanh shared: "As a lawyer and a child rights advocate, I believe that the use of legal terminology in this case needs to be considered more carefully, to ensure compliance with the humanitarian spirit of the Vietnamese legal system and international standards on child protection.

Article 14 of the 2008 Road Traffic Law clearly states that drivers are only allowed to overtake when they are certain that they will not cause danger to other road users. According to the scene at that time, the truck had encroached on the opposite lane and showed no signs of braking in time when encountering a dangerous situation.

Before the incident, on January 7, Mr. Phuc filed a complaint requesting the cancellation of the decision not to prosecute case No. 760 of the Tra On District Police Investigation Agency, forcing the Tra On District Police Investigation Agency to verify and investigate the cause. However, after studying the records and documents related to the complaint settlement of the Tra On District People's Procuracy and examining the settlement results, the Vinh Long Provincial People's Procuracy concluded that Mr. Phuc could not provide documents to prove the statements of TNXN and LMN as the people accompanying Tr. as stated in the complaint.

But according to the crime scene investigation records dated September 4, 2024 and September 23, 202, the Tra On District Police Department fully recorded the locations of the vehicles, victims, and plow marks left at the scene, witnessed by many people, including XN and MN.
