Truong My Lan asked to repay bonds to bondholders with all money and assets

According to the investigating agency, Ms. Truong My Lan has asked to take responsibility for her mistakes and will repay bonds to bondholders using all money and assets.

According to the conclusion of the investigation of the case that occurred at Van Thinh Phat Group, Saigon Commercial Joint Stock Bank ( SCB) phase 2, the Investigating Police Agency of the Ministry of Public Security assessed that Ms. Truong My Lan had a change in awareness.

The Police Department for Investigation of Crimes on Corruption, Economy and Smuggling (C03) of the Ministry of Public Security has just concluded the investigation of the case that occurred at Van Thinh Phat Group, SCB Bank and related units, proposing to prosecute 34 defendants in 3 groups of crimes of misappropriating assets, money laundering and illegal transportation of currency across borders.

Accordingly, Truong My Lan, 68 years old, Chairman of the Board of Directors of Van Thinh Phat Group was proposed to be prosecuted for fraudulent appropriation of assets, money laundering and illegal transportation of currency across the border.

The investigation conclusion shows that Truong My Lan and her accomplices issued 25 packages of short bonds (30,869 billion VND) without collateral, currently insolvent of 4 legal entities. These 4 legal entities include An Dong Real Estate Company, An Thuan Investment Company, Sunny World Company and Ho Chi Minh City Service - Trading Company. HCM; up to now, there are outstanding loans of more than VND 30,081 billion of more than 35,824 investors.

In 2018, when SCB was in a state of inspection and examination by management agencies, applying for credit from SCB faced many difficulties. Along with that, the bad debt situation lasted for a long time, so around August 2018, Truong My Lan and Dinh Van Thanh (Chairman of the Board of Directors of SCB), Vo Tan Hoang Van (General Director of SCB), Nguyen Phuong Hong (Deputy General Director of SCB), Nguyen Tien Thanh (Chairman, General Director of TVSI Securities Company) and Ho Buu Phuong (Deputy General Director of Van Thinh Phat Group) used An Real Estate Company Dong and other companies issue individual bonds to raise money from people to handle financial difficulties for SCB.

After that, key personnel of SCB, TVSI Securities Company, Van Thinh Phat Group and the issuer had a meeting to discuss and plan to create bonds and through TVSI Securities Company, SCB issued and offered to the public at an interest rate higher than the interest rate on savings deposits at SCB.

Ministry of Public Security: Ms. Truong My Lan has a change in perception

In the process of working with the investigating agency, Ms. Truong My Lan admitted that the policy of issuing bonds of the group's companies is contrary to the law, because the money from bond issuance is not used for investment, production and business, creating actual revenue to ensure the repayment of bond debts, but is used to handle financial amounts for SCB Bank leads to insolvency.

According to the investigation agency, Ms. Truong My Lan has asked to take responsibility for her mistakes and will repay bonds to bondholders by using all money, Ms. Lan's assets have been distrained, blocked, prevented, seized and all funds, property that the People's Court of Ho Chi Minh City. Ho Chi Minh City has declared that individuals/organizations must return or compensate Ms. Lan to prioritize the payment of debts and bond interest to bondholders.

In addition, Ms. Lan hopes that individuals/organizations involved in the use of money raised from bonds of these companies must be jointly responsible for ensuring the full repayment of debts and bond interest for the people.

The investigating agency determined that Ms. Truong My Lan's behavior had committed the crime of "fraudulent appropriation of property" with an amount of 30,081 billion VND.

The investigating agency assessed that throughout the case from phase 1 to phase 2, Ms. Truong My Lan had a change in awareness and sense of the law, admitted her criminal behavior in issuing bonds, misusing them, leading to particularly great consequences for the people.

Ms. Lan also accepted responsibility for compensation for damages, refund money to bondholders, apply for the use of assets disstrained, blocked, prevented or recovered in cases to prioritize debt repayment to bondholders.

Ms. Lan has also sincerely declared, repented, has a good character, Van Thinh Phat Group and her family have paid money to remedy part of the consequences. Therefore, the investigating agency proposes to consider when sentencing.
