Accordingly, the appeal was sent from the detention center. In the petition, defendant Truong My Lan appealed the entire sentence. Ms. Lan said she participated in the restructuring process of SCB bank but did not appropriate money from this bank. At the same time, Ms. Lan also asked the appellate court to reconsider the crime.
In addition to Ms. Truong My Lan's appeal, there are currently 50 other defendants who have filed an appeal with the court. The Ho Chi Minh City People's Court is continuing to receive and gather appeals from the defendants in the case. However, the Court has not provided any further information.
Previously, on April 11, the City People's Court sentenced defendant Truong My Lan to 20 years in prison for violating lending regulations in the operations of credit institutions; exclusion from society for property embezzlement; 20 years in prison for bribery. The general penalty is the death penalty.
Regarding civil liability, the first instance judgment forced defendant Truong My Lan to reimburse SCB Bank for the outstanding balance of 1,243 loans as of October 17, 2022, equivalent to an amount of 673,800 billion VND.
The court decided to continue to distrain and temporarily seize real estate, shares, land use rights certificates, savings books, and other assets of companies under Van Thinh Phat Group that are owned or owned by Van Thinh Phat Group. assigned to individuals in the names of the defendants and other related persons to ensure the execution of their respective obligations.
In addition, the court announced that it would continue to distrain a series of assets related to the case as well as recommend clarifying many other contents.
Although defendant Truong My Lan did not admit the crime, the jury had enough basis to determine that Ms. Lan held more than 91.5% of SCB Bank's shares, holding almost absolute control at SCB. The jury found that the testimony of defendant Lan and the defense lawyer that Ms. Lan only held 15%, the rest belonged to foreign shareholders and asked friends to name her was unfounded and had no basis for acceptance.

Three defendants, former SCB bank leaders, were sentenced to life in prison: Dinh Van Thanh, Bui Anh Dung, and Vo Tan Hoang Van. Defendant Do Thi Nhan (head of the SCB Bank Inspection Team) was sentenced to life in prison for accepting bribes. The remaining defendants received sentences ranging from 3 years in prison to suspended sentences to 20 years in prison.
According to the first instance judgment, before the merger, defendant Truong My Lan purchased shares of three banks: SCB Bank, Vietnam Tin Nghia Bank and De Nhat Bank. When the State Bank allowed the merger of three banks, taking advantage of the bank restructuring policy, as of October 2022, defendant Lan had acquired and held about 91.5% of shares in SCB Bank. .
Although defendant Lan does not hold positions at SCB, this defendant indirectly owns over 91% of the bank's shares, so defendant Lan has the right to dominate and decide on the bank's issues. Therefore, defendant Lan is satisfied that he is the subject of the crime of property embezzlement.
Taking advantage of her role as an almost absolute shareholder of SCB Bank, Truong My Lan directed the defendants: Bui Anh Dung, Truong Khanh Hoang, Tran Thi My Dung, Vo Tan Hoang Van... to withdraw money from the bank. SCB to serve its purpose caused particularly great damage.
