According to experts in the field of unmanned aerial vehicles, the type of drone used in light shows has no commercial value when separated from the flight formation. They do not have a built-in camera, cannot be controlled individually, and parts such as batteries or controllers are also not compatible with common drones or FPVs on the market.
Talking to reporters, lawyer Truong Van Tuan, Head of Trang Saigon Law Office, said that drones used in the program are often assets of great value, which can contain private data. The occupation, sale, or use when picked up without returning it may be administratively handled, even criminal, depending on the severity.
According to lawyer Truong Van Tuan, Article 15 of Decree 144/2021/ND-CP (regulations on sanctioning administrative violations in the field of security, social order and safety; prevention and control of social evils; fire prevention and fightin.g; rescue and rescue; prevention and control of domestic violenc.e) clearly states which person "uses, buying, selling, mortgaging, illegally pledging or occupying other people's property" will be fined from 3 million to 5 million VND.
Violators will be subject to an additional sanction of confiscation of material evidences and means of administrative violations; being subject to remedial measures such as returning illegal profits obtained from committing acts of violation or returning property due to illegal occupation.
According to Article 176 of the Criminal Code 2015 (amended and supplemented in 2017), "a person who deliberately fails to return to the lawful owner or manager or fails to hand over to the responsible agency the property valued at between 10 million and less than 200 million VND, or less than 10 million VND but the property is a relic, antiques or objects of historical or cultural value that are mistakenly handed over or found or caught by themselves, after their owners, lawful managers or responsible agencies request the return of such assets in accordance with law, they shall be subject to a fine of between VND 10 million and 50 million. non-custodial reform for up to 2 years or imprisonment from 3 months to 2 years". If the property is worth 200 million VND or more or the property is a national treasure, the violator will be sentenced to up to 5 years in prison.
"Thus, a person who picks up a drone but does not return it to the owner, depending on the value of the number of drones picked up, that person can be fined up to 50 million, non-custodial reform for up to 2 years or imprisoned for up to 5 years," Mr. Tuan explained.
In addition, if you know that the drone was picked up by someone else but did not pay it to the owner but still bought it, depending on the nature, severity and consequences of this act, the buyer may be sanctioned for administrative violations or prosecuted for criminal liability. The person who buys the property, if he knows that it was picked up by another person but does not pay but still buys it, may be prosecuted for criminal liability with a fine of up to 100 million VND, or a non-custodial reform penalty of up to 3 years, or a prison sentence of up to 15 years...
