Nguyen Phuong Hang received a reduced sentence even though he did not appeal, why?

The court also reduced the sentences of 4 defendants in the case, reducing Dang Anh Quan from 2 years and 6 months to 2 years in prison (detained on February 24, 2023). The defendants Huynh Cong Tan, Nguyen Thi Mai Nhi and Le Thi Thu Ha were all sentenced to reduce their sentences from 1 year and 6 months to 1 year, the term of imprisonment from the date of serving the sentence.

On appeal for mitigation of punishment and suspended sentence, the appellate court held that the defendants had paid remedial money and court costs... This is considered a new mitigating circumstance of civil liability. In addition, at the appeals court, defendant Dang Anh Quan also admitted the entire offense and repented. Thereafter, the court sentenced the defendants to the said sentence.

According to the case file, from the end of April 2021 to March 2022, the defendant Nguyen Phuong Hang, through 12 social media accounts managed by this defendant, livestreamed live statements online with fabricated content, false, seriously offending the reputation and honor of individuals.

The defendants in the case have posted information in cyberspace of personal secrets, family secrets and private life against 10 people including: Mr. Vo Nguyen Hoai Linh (artist Hoai Linh), Ms. Nguyen Thi My Oanh (singer Vy Oanh), Ms. Dang Thi Han Ni (journalist, lawyer), Mr. Nguyen Duc Hien, Ms. Tran Thi Thuy Tien (singer Thuy Tien) and her husband Mr. Le Cong Vinh, Mr. Huynh Minh Hung (singer Dam Vinh Hung), Ms. Đinh Thi Lan, Ms. Le Thi Rich, and Ms. Truong Viet Ha.

At the appeal hearing, Hang affirmed that she had gone through her family and lawyer to fulfill her court fees and civil liability obligations after the first instance verdict.

The reduction of this sentence depends on Ms. Hang's performance and execution. Therefore, if Ms. Hang serves her sentence well, she can have her sentence reduced and not have to serve all of her sentence.

Specifically, according to Article 6 of Joint Circular 02/2013 of the Ministry of Public Security - Ministry of National Defense - Supreme People's Court - Supreme People's Procuracy, guiding the implementation of regulations on reducing the term of imprisonment for prisoners.

Accordingly, prisoners who fully meet the following conditions shall be recommended to reduce the term of imprisonment:

- Having served at least one-third of the term for imprisonment of thirty years or less or twelve years for life imprisonment;

- Much progress has been made in the good observance of the rules of prisons, detention centers and detention houses; actively study and work for re-education and must have enough ratings to serve a prison sentence of good or higher. Inmates sentenced to imprisonment for three years or less must have at least one last quarter graded as good or higher.
