Accordingly, on May 17, from Chi Hoa prison, Ms. Nguyen Phuong Hang filed an application to refuse 8 lawyers including: Ha Ngoc Tuyen, Do Hai Binh, Pham Danh Tin, Hoang Thi Hoai Tho, Tran Thi Phu, Dang Hoai Vu, Nguyen Dinh Kim and Nguyen Trung Chanh.

After reviewing, the People's Court of Ho Chi Minh City issued a notice to the above lawyers that they are no longer the defense for Ms. Nguyen Phuong Hang at the upcoming first-instance trial.

It is known that these lawyers were invited by Phuong Hang's relatives. Thus, up to now, Ms. Phuong Hang has only 1 defense lawyer, Ho Nguyen Le.

Previously, on April 28, the People's Court of Ho Chi Minh City accepted the case of Nguyen Phuong Hang and four accomplices for the crime of abusing democratic freedoms to infringe upon the interests of the State, the legitimate rights and interests of organizations and individuals. core.

According to the indictment, Ms. Nguyen Phuong Hang, through her YouTube and TikTok social networking accounts, organized many live broadcasts (livestreams) over the Internet to infringe on the privacy of her privacy, and affect the reputation and honor of the company. Mr. Vo Nguyen Hoai Linh (artist Hoai Linh), Ms. Nguyen Thi My Oanh (singer Vy Oanh), Ms. Dang Thi Han Ni (journalist Han Ni), Mr. Nguyen Duc Hien (Deputy editor of Ho Chi Minh City Law newspaper). Defendant Nguyen Phuong Hang took advantage of his influence, used the functions of social networks on the Internet, held many live broadcasts of unverified information related to other people's private lives, which uses words that are offensive to honor and dignity.

During the investigation, defendant Nguyen Phuong Hang admitted that the information he had said about the above individuals was because he read on the Internet and dreamed, had not been verified and had no basis.

For individuals who use YouTube channel to share information related to Nguyen Phuong Hang for the purpose of "like sentences", increase income, Ho Chi Minh City Police Department and relevant functional units are verifying, clarification for processing.

The police of Ho Chi Minh City identified 3 suspects Nhi, Ha, and Tan who performed the tasks of posting information on the social network Facebook about the title, time, and link to the YouTube channel, TikTok will broadcast the livestream; print the contents that defendant Nguyen Phuong Hang will speak, give to defendant Nguyen Phuong Hang before the livestreams; prepare and use electronic means and devices to serve livestream and broadcast livestream on the social network accounts of defendant Nguyen Phuong Hang.

These three defendants also participated in hosting the livestreams, announcing the number of viewers, reading comments on the live stream, etc.

As for the accused Dang Anh Quan, the authorities determined that Mr. Quan had directly participated in many livestreams with Nguyen Phuong Hang. During these livestreams, Dang Anh Quan spoke, commented, and interacted with Nguyen Phuong Hang about content that seriously offended the honor, reputation and dignity of many individuals.

Defendant Nguyen Phuong Hang and 4 accomplices are entitled to the application of extenuating circumstances because the offender sincerely declares and repents.

In addition, Ms. Nguyen Phuong Hang was awarded many certificates of merit by some State agencies and social organizations for volunteering activities, which is a mitigating circumstance for criminal responsibility.

However, Ms. Hang and 4 accomplices have 2 aggravating circumstances of criminal liability, which is an organized crime and 2 or more crimes.

Since then, the People's Procuracy of Ho Chi Minh City has prosecuted Ms. Nguyen Phuong Hang and 4 accomplices before the People's Court of Ho Chi Minh City for trial on charges of abusing democratic freedoms to infringe upon the interests of the State, the legitimate rights and interests of the organization. organizations and individuals.

Clause 2, Article 331 of the current Penal Code stipulates the penalty frame for this crime from 2 years to 7 years in prison.
