The incident of a shipper being "physically impacted" until fainting in Binh Duong, which has caused a stir in public opinion in recent days, has just had a new development. The perpetrator has been temporarily detained by the authorities.
On March 24, the Investigation Police Agency of Binh Duong Province Police said it had detained a man who used a knife to slas.h a male delivery person to investigate the act of intentionally causing injury.
According to initial information, Mr. N.D.T (born in 1999, from Dak Lak province), currently works as a shipper in Binh Duong area. On March 20, Mr. T. went to deliver goods to a woman living on DT746 road (Tan Lap commune, Bac Tan Uyen district), when the two sides had a conflict and argued, leading to a fight.
After that, the male shipper left and was chased by the woman and her husband, who continuously "physically impacted" him, causing him to faint on the spot. People helped take the victi.m to the emergency room. On the morning of March 21, Mr. T's wife, Ms. H., posted the incident on social media.
According to Ms. H., at 2 p.m. on March 20, her husband came to deliver goods to a woman named Th., and the two sides argued back and forth. "Because Ms. Th. insulted my husband with obscene words, threw stones, hit and cursed my husband with a broom, he defended himself and then left," she said.
Ms. H. added that when Mr. T. had just gone a short distance, the woman and her husband drove after him in a car and used a knife to hit him in the head. Not stopping there, the two people also used helmets to continuously hit him in the head and kicked the male shipper.
Ms. Th.'s husband then said, "I'll bea.t you to deat.h." The woman asked her husband to smash things in the container so that Mr. T. would have to pay the company. The assaul.t left Mr. T. seriously injured and bleedin.g from the head, and he fainted on the spot.
The male shipper was taken to the Bac Tan Uyen District Medical Center for emergency treatment. On the same day, the family requested to transfer him to Binh Duong General Hospital for treatment. Ms. H. really hopes that the authorities will intervene to verify and clarify to protect her husband's rights. Upon receiving the report, Tan Lap Commune Police invited the couple involved in the incident to the police station to take statements.
Regarding the incident, on the afternoon of March 24, a video clip of more than 1 minute long was shared by social media users, recording the conflict between a male shipper and a gir.l, according to Dan Tri newspaper. According to security camera footage, at 1:37 p.m. on March 20, Mr. N.D.T. delivered goods to Tan Lap Commune, Bac Tan Uyen District, Binh Duong Province. During the delivery, Mr. T. and the gir.l got into an argument. The gir.l suddenly attacked Mr. T. with her hands.
The male shipper responded by kickin.g the gir.l, but she dodged in time. Not stopping there, the gir.l picked up a rock and threw it at Mr. T., and he responded in the same way. When Mr. T. was about to leave, the gir.l continued to point and throw rocks at him. After the shipper left, the gir.l and her husband chased after him, attacked and knocked down Mr. T.'s motorbike, injuring the victi.m and requiring emergency hospitalization.
What is the penalty for intentional injury?
A person who intentionally causes injury to another person but not to the extent of being prosecuted for criminal liability under Article 134 of the Penal Code 2015, amended and supplemented in 2017 (disability rate below 11% and without the circumstances specified in Clause 1 of this Article) shall be fined according to the provisions of Point a, Clause 5, Article 7 of Decree 144/2021/ND-CP, specifically:
"Article 7. Violation of regulations on public order
5. A fine of from VND 5,000,000 to VND 8,000,000 shall be imposed for one of the following acts:
a) Intentionally causing injury or harm to the health of another person but not being prosecuted for criminal liability;
b) Disturbing public order while carrying primitive weapons, support tools or other tools, objects or means capable of causing harm;

Thus, the administrative penalty for intentional injury according to the law is a fine of VND 5,000,000 to VND 8,000,000. In addition, the person subject to the administrative penalty may also have the means of causing the injury confiscated (Clause 13, Article 7, Decree 144/2021/ND-CP) and must pay all medical examination and treatment costs for the injured person (Clause 14, Article 7, Decree 144/2021/ND-CP).
