In case of committing organized crimes, for self-interest, using sophisticated tricks or causing damage from 300 million to less than 1 billion VND, the penalty is from 3 to 12 years in prison. If causing damage of 1 billion VND or more, the offender will be sentenced to 10 to 20 years in prison.

With the amount of tax allegedly falsely declared up to about 2,100 billion VND, Hoang Huong's case belongs to the highest penalty bracket. In addition to imprisonment, according to the law, the defendant may be banned from holding certain positions for a period of 1 to 5 years.

Regarding the issue of charity, Article 51 of the Criminal Code stipulates mitigating circumstances of criminal liability. In particular, some commonly applied circumstances such as: the offender sincerely declares, repents, voluntarily repairs, compensates for damage or voluntarily remedies the consequences. Charitable activities are not included in the list of mandatory extenuating circumstances. However, Clause 2 of Article 51 stipulates that the Court may consider "other circumstances" as extenuating circumstances if it considers that it is beneficial to the defendant and consistent with the facts of the case.

According to the lawyer's analysis, charity work can be considered as a mitigating circumstance, but only in cases where this activity is voluntary, comes from goodwill and brings real value to the community. On the contrary, if charity is only for the purpose of polishing the image, attracting sympathy or concealing criminal acts, the Court will consider very closely, even not recognizing it as a mitigating circumstance.
