The preliminary inspection results of ASIA LIFE - the manufacturer of Kera vegetable candies show that there is no vegetable garden at the headquarters. Notably, a representative of this company said that the unit only produces Kera vegetable candies according to orders with the formula of Sister Rot Company.
"The announcement of the product is carried out by Sister Rot Company, we will package it as required. We don't know how Sister Rot Company advertises and sells products," a representative of ASIA LIFE Joint Stock Company informed.
With this answer, it seems that the responsibility has been "pushed" to Sister Rot Company.
However, the CEO of a high-tech pharmaceutical factory said that the response of the Kera vegetable candy manufacturer was "not reasonable".
"Basically, the manufacturer must know the quality standards of the product and be responsible for the quality standards as well as know how much active ingredient content is in the product. At the same time, manufacturers must comply with regulations on product labeling as well as publish quality standards," said this CEO.
Analyzing from a legal perspective, Dr. Dang Van Cuong, lawyer, Hanoi Bar Association said that over the past time, the authorities have detected many cases of importing foreign goods but cheating on the origin, "disguised" Vietnamese goods to sell, consumption in the market. There have been cases of being handled by criminal sanctions.
Therefore, in this case, according to lawyer Cuong, the authorities need to clarify the raw material area, technical standards in the process of care, preservation and processing of finished products, the process of ensuring food hygiene and safety, procedures and conditions for product announcement before being put on the market.
Ms. Rot Company as well as the production unit must be responsible for explaining to the authorities about the contents: Where are the vegetables for candy production? Is food hygiene and safety ensured? Are the ingredients from Vietnam or not? How is the processing stage?
These are important issues to determine whether there is a mistake or not, whether there is fraud about the origin of goods or not. From there, the authorities will clarify the legal responsibilities of relevant organizations and individuals.
"In case of fraud on the origin of products or failure to ensure quality, food hygiene and safety or other violations of commercial fraud, it is necessary to strictly consider and handle relevant organizations and individuals in accordance with the law.
If the act is to the extent that it must be criminally handled for the crime of producing counterfeit goods, deceiving consumers or other violations of the law specified in the criminal code, it should be strictly handled to deter and educate.
Those who know that they are doing wrong business activities but still help and abet products to enter the market to deceive consumers will be identified as accomplices and will be dealt with strictly," said lawyer Dang Van Cuong.
In case of only violating false advertising, organizations and individuals that carry out false advertising activities will be administratively sanctioned with a fine of up to VND 80,000,000 for individuals and up to VND 160,000,000 for organizations.
Persons who commit fraudulent advertising acts shall not only be administratively sanctioned but may also be examined for penal liability according to the provisions of Article 197 of the Criminal Code with penalties of up to VND 100,000,000 or non-custodial reform for up to 3 years.
It can be seen that the above incident is also a warning to consumers about being careful when buying products advertised on social networks. Not every advertisement from KOLs is accurate, and consumers need to check the information carefully before making a purchase decision.
