On September 26, Vinh Long Provincial Police announced the results of the health assessment of driver Nguyen Van Bao Trung to Ms. Nguyen Thi Hien - the mother of the victim in the incident that happened more than a year ago.
According to the conclusion from the Southwest Regional Forensic Psychiatry Center, at the time of driving the vehicle that caused the accident, Trung had the ability to perceive and control his behavior. However, Trung has now been diagnosed with a mental illness, a state of "moderate dementia", losing the ability to perceive and control his behavior.
This conclusion states that before, during and after the accident, Trung showed no signs of mental illness. However, since the time of injury by the victimâs father in April 2025, the defendantâs health has changed, leaving serious sequelae, and he is currently no longer able to perceive normally.
Disagreeing with the above results, Ms. Hien said that she had requested the investigation agency to request a re-examination at another unit, and affirmed that she would clearly state her request for compensation when the case was brought to trial. The family wishes to be provided with an official document on Trung's health condition and hopes that the prosecution agency will soon have a conclusion and transfer the file to the Procuracy for prosecution and public trial.
The case file shows that on the morning of September 4, 2024, Trung was driving a truck from Vam Vong to Vinh Xuan commune, Tra On district. When he discovered that the truck in front of him stopped on the right side, Trung turned on his signal and drove his vehicle into the left lane to pass. At the same time, a group of three students were riding electric bicycles in the opposite direction. While avoiding each other, one student was unable to react in time, collided with his friend's vehicle, fell onto the road and was killed by the truck driven by Trung. The victim was taken to the emergency room but did not survive.
Immediately after that, Tra On District Police initially determined that "there was no crime" and decided not to prosecute the case. The family filed a complaint, but the Tra On District People's Procuracy and Vinh Long Province both rejected the complaint.
On April 28, 2025, after directly examining the file, the Supreme People's Procuracy determined that the previous decisions to reject the complaint did not ensure legal basis. This agency believed that Trung's overtaking in conditions where there were obstacles ahead, and there were vehicles going in the opposite direction but still encroached on the lane, violated road traffic safety regulations, showing signs of committing the crime of "Violating regulations on road traffic participation".
On May 7, 2025, Vinh Long Provincial Police initiated a criminal case, determining that the cause of the accident was due to driver Trung driving into the left lane to overtake.
During the investigation, Trung spent nearly a month in the hospital, and was discharged with severe sequelae, including hemiplegia and loss of communication ability. On August 5, 2025, Trung was prosecuted, released on bail, and continued to be investigated for "Violating regulations on road traffic participation" under Article 260 of the Penal Code.
Trung is still in a state of unconsciousness and unable to respond. Meanwhile, the victim's family continues to send petitions, requesting clarification of the responsibility of the prosecution agencies of Tra On district and Vinh Long province for not previously initiating a case. They believe that it is necessary to consider signs of "judicial violations" and strictly handle any violations by officials.
The victim's family affirmed that their only wish is for the case to be brought to public trial soon, ensuring fairness, transparency, and compliance with the law.
