In Clause 10, Article 5, Decree 100/2019/ND-CP stipulates, drivers of vehicles being cars and similar vehicles if they fail to comply with the requirements for alcohol content testing of public officials, a fine of VND 30-40 million. Regarding criminal sanctions, in case an alcohol content violator not only fails to sign the record but also commits acts of using force, threatening to use force or using other tricks to obstruct the performance of their duties, they may be examined for criminal liability for the crime of "resisting persons on duty" specified in Article 330 of the Ministry The 2015 Criminal Law, amended and supplemented in 2017 carries a maximum penalty of up to 7 years in prison.
