When walking on Hoang Hoa Tham Street (heading from Bac Giang City to Tan Yen district), Tam saw that the working group of the Bac Giang City Police Traffic Team was checking alcohol content, signaled to stop the car to check but Tam did not comply, but the driver of the car turned and ran away, then crashed into the team's motorbike.

When the police stopped the car, Tam was unable to run away but did not get out of the car to show his documents. The crew then had to break the driver's side windshield to open the car door, restraining Tam.

The alcohol test results for the driver Tam showed a result of 0.595mg/l breathing air (exceeding the dramatic level specified in Decree 100).

At the police office, Tam confessed that he had previously used alcohol and driven a car from Õng village, Huong Gian commune, Yen Dung district to Cao Xa commune, Tan Yen district (Bac Giang), when he went to Hoang Hoa Tham road when the incident occurred.

This is also the highest penalty bracket for violations of alcohol content.

Specifically, the refusal to blow into the alcohol meter by drivers using vehicles or working will be subject to administrative penalties depending on the type of vehicle used.

In Clause 10, Article 5, Decree 100/2019/ND-CP stipulates, drivers of vehicles being cars and similar vehicles if they fail to comply with the requirements for alcohol content testing of public officials, a fine of VND 30-40 million. At the same time, it is possible to lose a driver's license (GPLX) for 22-24 months and have the vehicle impounded for up to 7 days.

Regarding criminal sanctions, in case an alcohol content violator not only fails to sign the record but also commits acts of using force, threatening to use force or using other tricks to obstruct the performance of their duties, they may be examined for criminal liability for the crime of "resisting persons on duty" specified in Article 330 of the Ministry The 2015 Criminal Law, amended and supplemented in 2017 carries a maximum penalty of up to 7 years in prison.
