According to the initial investigation, around 20:55 on November 4, the working group of the Traffic Police Department of Thanh Hoa province cooperated with the District Traffic and Order Police Team to check the alcohol content at km 112 300, National Highway 45, section through Quarter 1, Ben Sung town, Nhu Thanh district.

While on duty, traffic police spotted two youths riding motorcycles without helmets.

The police signaled to stop the car for administrative inspection but Le Minh Phong, 18 years old, residing in Yen Tho commune, Nhu Thanh district, driving a motorbike carrying N.H.Tr., 27 years old, residing in Yen Tho commune did not obey the order, the throttle hit the working group and hit Captain Le Xuan Linh, traffic police under H.Nhu Thanh Police, causing Captain Linh to be injured, unconscious, and taken to the emergency hospital.

Immediately after the incident, the forces of H.Nhu Thanh Police coordinated with Ben Sung City Police to bring Phong and his companions to the headquarters to clarify the violation.

According to information from Thanh Nien, also on the evening of 4.11, through alcohol testing, the working group found that the driver of car BS 36A - 888.88 violated the alcohol content.

The driver of the car with the above number plate "VIP" is Mr. L.V.V (53 years old, Thuong Ninh commune, Nhu Xuan district, Thanh Hoa). Tests found that the driver had an alcohol level in excess of 0.254 mg/l breathing gas.

The working group has made a record of sanctioning administrative violations of VND 17 million against Mr. L.V.V., at the same time stripping the driver's license for 17 months, and impounding the vehicle for 7 days.

To ensure traffic order in the area, traffic police forces (CSGT) in localities across the country are strengthening checkpoints for traffic violations, including handling alcohol violations. However, there have been many drivers who deliberately do not blow on the alcohol content measuring device when requested by the police. Accordingly, the case of refusal to test the alcohol content from the traffic control will be handled in accordance with the provisions of law.

Accordingly, the act of failing to comply with the alcohol content test request of a public official is contrary to the provisions of law and may be administratively sanctioned according to Articles 5, 6, 7, and 8 of Decree 100/2019/ND-CP. This is also the highest penalty bracket for violations of alcohol content.

Specifically, the refusal to blow into the alcohol meter by drivers using vehicles or working will be subject to administrative penalties depending on the type of vehicle used.

Specifically, in Clause 10, Article 5, Decree 100/2019/ND-CP stipulates, drivers of vehicles being cars and similar vehicles if they fail to comply with the requirements of alcohol content tests of public officials, a fine of VND 30-40 million. At the same time, it is possible to lose a driver's license (GPLX) for 22-24 months and have the vehicle impounded for up to 7 days.

At the same time, Decree 100/2019/ND-CP also clearly stipulates that drivers of vehicles that are motorbikes, motorcycles (including electric scooters), motorcycle-like vehicles and motorcycle-like vehicles that fail to comply with the requirements of alcohol testing of public officials will be fined from VND 6-8 million. In addition, they are also deprived of the right to use the license for 22-24 months and impounded for up to 7 days.

Drivers of tractors and specialized vehicles will be fined from 16-18 million VND, according to Point b, Clause 9, Article 7. At the same time, he was also deprived of the right to use the GPLX; Certificate of fostering legal knowledge of road traffic if driving a specialized motorbike for 22-24 months.

In addition, cyclists and electric bicycles who fail to comply with the requirements of alcohol testing of traffic traffic are also fined from 400,000 - 600,000 VND, according to Point d, Clause 4, Article 8 of the Decree.
