Recently, the Investigation Police Agency of Vinh Long Province Police prosecuted driver NVBT (born in 1992) - the driver of the truck that caused the accident that killed a resident in Tra Con commune.

Answering questions, lawyer Le Quang Vu - Director of Cong Binh Law Firm (HCMC) said: When there is a basis to determine that the person committing a socially dangerous act does not have criminal responsibility according to Article 21 of the Penal Code, depending on each stage of the proceedings, the investigation agency, the prosecutor's office or the court will request a forensic psychiatric examination.
According to Mr. Vu, based on the conclusion of the forensic psychiatric assessment, the prosecutor can decide to apply compulsory medical treatment during the investigation and prosecution stages; the court can apply this measure during the trial or execution of the sentence. This is a procedure to ensure that the case is handled in accordance with the law, while protecting the rights of all parties involved.
Lawyer Le Quang Vu said that the case is currently under investigation. Pursuant to Article 449 of the Criminal Procedure Code, the Investigation Police Agency of Vinh Long Province will conduct a forensic psychiatric assessment of the health condition of driver T.
In case the assessment results determine that the accused has a mental illness or other illness that causes loss of cognitive ability or loss of ability to control behavior, the investigation agency will send a document requesting the application of compulsory medical treatment measures along with the assessment conclusion to the same-level procuracy for consideration and decision.
According to regulations, within 3 days from the date of receiving the request and the conclusion of the assessment, the prosecutor will decide to apply medical treatment measures to the accused. If there is not enough basis, the prosecutor has the right to request the investigation agency to request additional assessment or re-assessment.
If the prosecutor decides to apply compulsory medical treatment, the investigation agency will temporarily suspend the case according to Point b, Clause 1, Article 229 or suspend the investigation of the accused according to Point a, Clause 1, Article 230 of the Criminal Procedure Code.
On the contrary, if the assessment results determine that driver T. does not suffer from mental illness or other illness that causes loss of cognitive ability and behavioral control, or if his health is restored within the statute of limitations for criminal prosecution, the investigation will continue in accordance with regulations.
In cases where the driver's health condition is still not sufficient for procedural activities, such as being unable to fully perceive, communicate or work, the accused will continue to receive treatment until he or she can participate in the investigation, prosecution and trial process.
Lawyer Le Quang Vu emphasized: "After driver T.'s health improves, the police investigation agency will take statements, interrogate, work and investigate to clarify the act of 'Violating regulations on road traffic participation' according to Clause 1, Article 260 of the Penal Code."
Previously, on August 5, the Investigation Police Agency of Vinh Long Provincial Police worked with the victim's family.
