Recently, Hanoi City Police issued an order to detain people in emergency cases and temporarily detain Nguyen Long Vu (born 2002, from Hop Thinh, Bac Ninh), the person who influenced the coffee shop staff in Times City for the act of "Disturbing public order".
During the investigation, the police determined that Nguyen Long Vu was the person who directly attacked Mr. Ngo Minh D. (a coffee shop employee). Mr. D. filed a request for an injury assessment and requested that the subject be strictly handled according to the law.
Regarding Nguyen Van T. (27 years old) - the character called "the boss" by the online community, Hanoi City Police have drawn up a record, allowed T. to write a guarantee and continue to be released on bail to serve the investigation, verification and handling according to the law.
The case is still the focus of public attention. Many people cannot help but wonder what charges and sentence Nguyen Long Vu will face. And will Nguyen Van T. be prosecuted?
Regarding this issue, lawyer Nguyen Anh Thom - Head of Nguyen Anh Law Office (Hanoi Bar Association) acknowledged that the case shows signs of a quite serious crime.
"Through reviewing the case, it can be seen that the subject's behavior demonstrates hooliganism, aggression, disregard for the lives and health of others, and civilized rules of conduct and respect for public order," said lawyer Thom.
According to the lawyer, with being detained for the crime of "Disturbing public order", Nguyen Long Vu can be punished according to the provisions of Article 318 of the Penal Code.
Specifically: "Anyone who causes public disorder that negatively affects security, order, or social safety, or has been administratively sanctioned for this act or has been convicted of this crime, but has not had his criminal record expunged, but still commits the offense, shall be subject to a fine of 5-50 million VND, non-custodial reform for up to 2 years, or imprisonment from 3 months to 2 years."
In addition, Mr. D. has filed a request for injury assessment and requested that the subject be strictly handled according to the law. After the police complete the procedures for assessing the health damage rate, there will be a basis for handling the crime of "Intentionally causing injury".
If the appraisal result has a percentage, the subject must bear criminal responsibility for the crime of "Intentionally causing injury" according to the provisions of Clause 1, Article 134 of the Penal Code with the circumstance of "being of a hooligan nature".
Specifically, Article 134 stipulates: "Anyone who intentionally causes injury or harm to the health of another person with a bodily injury rate of 11-30% or less than 11% but the act is of a hooligan nature, shall be subject to non-custodial reform for up to 3 years or imprisonment from 6 months to 3 years.
As for Nguyen Van T., the young man raised his hand, immediately his "junior" stood up and went in to assault the coffee shop employee and then raised his hand and shouted "stop" 3 times. The police will clarify the motive and purpose of those actions and words.
If there is a basis to determine that those actions were to direct others to beat the male employee, causing public disorder, they will be handled as accomplices who initiated, directed, and incited others to commit crimes.
After the incident, according to netizens, there were many young people waiting outside to buy drinks and check in at the "CEO's chair", which is the blue felt chair in the middle of the shop.
The tables inside and outside the shop were full of customers. Inside the shop, the atmosphere was quite cheerful. People drank coffee and took pictures with the chair, reenacting the scene of "CEO" pointing.
The beverage and service department was quite busy with the sudden increase in customers. The shop has a beautiful location next to the musical fountain, with a clear view and delicious drinks.
