On April 12, the Investigation Agency prosecuted and temporarily detained 8 defendants for the crimes of "Production and trading of counterfeit food products" and "Violating accounting regulations causing serious consequences", including Vu Manh Cuong and Hoang Manh Ha.
Despite being the ones who directly contributed capital, managed and controlled all activities of Hacofood Group and Rance Pharma, the accuse.d Cuong and Ha 'shed their shells' by transferring the role of legal representative to Nguyen Thanh Luan and Nguyen Van Tu. In reality, both were only employees in charge of the business sector, while all decisions from production to product distribution were still manipulated by Cuong and Ha.
Specifically, in August 2024, Hoang Manh Ha transferred the position of Director of Rance Pharma Company to Nguyen Thanh Luan, and in October 2024, Vu Manh Cuong also transferred the same position at Hacofood Group Company to Nguyen Van Tu. However, the investigation agency determined that these actions were only intended to conceal the true management roles of the defendants Cuong and Ha.
Through initial investigation, the authorities determined that this group had established 9 joint-stock companies, creating a closed ecosystem from production to product consumption. These enterprises were responsible for registering product declarations, trading and distributing powdered milk produced at the factories of Hacofood and Rance Pharma - located in Phu Nghia Industrial Park, Chuong My District, Hanoi.
Investigation results show that Vu Manh Cuong currently holds controlling shares in Hacofood Group and Rance Pharma, specifically: 53.84% of shares in Rance Pharma Company; 27% in Hacofood Company; 20% in Big Four Company; 20% in Long Khang Company. At the same time, he is the legal representative of Hacofood branches in Vinh Phuc, Hoa Binh, Hai Duong, Hung Yen.
Hoang Manh Ha is also a major shareholder in the ecosystem: 45.19% of shares at Rance Pharma Company; 27% at Hacofood Company; 20% at Big Four Company; 20% at Long Khang Company; Director of Rance Pharma branches in 5 provinces: Vinh Phuc, Hoa Binh, Hai Duong, Hung Yen and Thai Nguyen.
According to the investigation agency, both Cuong and Ha also assigned Ho Sy Y (born in 1988, residing in Hong Loc commune, Can Loc, Ha Tinh) to be directly in charge of all production activities at the two factories of Rance Pharma and Hacofood Group. Y was identified as the person responsible for all products, including fake milk powder products that were put on the market.
Dr. and lawyer Dang Van Cuong (Head of Chinh Phap Law Office) said that this is one of the most serious criminal cases, with thousands of people suffering losses in this case, causing public outrage and threatening the health of consumers.
"It is worth noting that in order to sell such a huge amount of fake and counterfeit goods, the subjects used many advertising tricks to exaggerate the uses and effects of milk as a panacea, as a miracle product that can make children grow quickly, be healthy, smart, and cure the elderly,... making many people believe. In addition, there was also the support of many influential people on the internet," Mr. Cuong emphasized.
According to the Head of the Chinh Phap Law Office, during the investigation of the case, the investigation agency will clarify the acts of false advertising, fraudulent advertising and handle those who have assisted in these counterfeit sales activities to handle them according to the provisions of the law.
False advertising and violations of advertising laws are violations of the law. Depending on the nature and severity of the violation and the consequences, the person committing false advertising will be subject to administrative sanctions or criminal prosecution.
For celebrities involved in advertising to sell these products, the authorities will also clarify their roles, behaviors and legal responsibilities in the case.
In case they know clearly that these are fake goods, not guaranteed as announced but still assist in the sale of fake goods, they can be prosecuted for the crime of Deceiving customers according to the provisions of Article 198 of the Penal Code.
For those involved in the production of nearly 600 types of fake milk powder, Mr. Cuong said, the subjects could face the highest sentence of life imprisonment.
"The act of counterfeiting food products is very condemnable, counterfeiting powdered milk products is even more condemnable, it has negative impacts on special people in society, such as the elderly, children and the sick.
Therefore, the law stipulates that those who commit the act of producing fake food products may be subject to a maximum prison sentence of life imprisonment," lawyer Dang Van Cuong analyzed.
Article 193 of the Penal Code stipulates that anyone who produces or trades in counterfeit food, foodstuffs, or food additives shall be sentenced to imprisonment from 2 to 5 years.
Committing a crime in one of the following cases: Illegally gaining profits of 1.5 billion VND or more; Causing property damage of 1.5 billion VND or more... shall be punished with imprisonment from 15-20 years or life imprisonment.
In addition, offenders may also be fined from 20 to 100 million VND, banned from holding positions, practicing a profession or doing certain jobs from 1 to 5 years, or have part or all of their assets confiscated.
Commercial legal entities that commit crimes may be fined from 1-18 billion VND, have their operations permanently suspended or banned from doing business, banned from operating in certain fields...
In addition, for the crime of accounting violations causing serious consequences as prescribed in Article 221 of the Penal Code, according to lawyer Cuong, the penalty can also be up to 20 years in prison.
For customers who have purchased these fake milk products, the lawyer said they have the right to report the incident to the investigation agency and have the right to make a claim for compensation for damages for the prosecution agency to consider and resolve during the case settlement process.
