According to Thanh Nien newspaper, on March 26, the source said that the People's Court of Ho Chi Minh City has just decided to bring to trial the case of "abuse of trust and appropriation of property" that occurred at Tan Hiep Phat Trading and Services Co., Ltd. .
3 defendants were jointly prosecuted for the above crime, including: Tran Qui Thanh (former Director of Tan Hiep Phat Company), 2 daughters Tran Uyen Phuong (former Deputy Director of Tan Hiep Phat Company) and Tran Ngoc Bich (former Director of Tan Hiep Phat Company). Former Director of Tan Hiep Phat Company).
As expected, the trial will take place from April 23 to April 25, presided over by judge Huynh Van Truc.
The case has 4 individuals identified as victims, including Mr. and Mrs. Dang Thi Kim Oanh, Nguyen Van Chung, Lam Son Hoang and Nguyen Huy Dong. 35 other individuals were identified as people with related rights and obligations.
About 20 lawyers registered to participate, including 3 father and son defendant Tran Qui Thanh and 4 defense lawyers.
Citing news from Tuoi Tre newspaper, according to records, between 2019 and 2020, Mr. Tran Qui Thanh, Tran Ngoc Bich and Tran Uyen Phuong, through brokers, lent money to four individuals at an interest rate of 3%/year. month.
The loan condition is that the mortgaged property or project owners must sign a contract to transfer assets or shares of the project to hide the nature of the loan.
However, according to the investigation, when the borrower fully fulfilled the obligation to repay principal and interest as agreed, Mr. Tran Qui Thanh and his son gave reasons for not returning the property.
Specifically: Tran Qui Thanh and Tran Uyen Phuong lent Mr. Lam Son Hoang (residing in Phu Nhuan district) 115 billion VND by signing a fake notarized transfer contract, transferring four plots of land in Thu Duc City from Mr. Hoang. and Mr. Hoang's nephew to Mrs. Phuong.
Interest rate 3%/month; Late payment interest rate is 4.5%, faked by resale commitments.
When Mr. Hoang prepared enough money to pay, Mr. Tran Qui Thanh's side used the excuse that Mr. Hoang was late in paying and refused to redeem the property.
Appropriation value (determined as the asset value at the time the borrower loses the right to repurchase the asset - loan amount) is 80.3 billion VND.
In the second case, Tran Qui Thanh and Tran Uyen Phuong lent Mr. Nguyen Huy Dong (residing in District 3) 80 billion VND in a fake contract to transfer two plots of land in Binh Tan district from Mr. Dong to Ms. Phuong's name.
The interest rate on this loan is also 3%/month; Late payment interest rate is 4.5%, faked by resale commitments.
However, when Mr. Dong prepared enough 80 billion VND to receive back the two plots of land, Mr. Thanh and his son requested to pay an additional interest and penalty of 15 billion VND. Mr. Dong texted Mr. Thanh asking him to reduce the amount, but Mr. Thanh did not reply.
After that, Ms. Tran Uyen Phuong sued Mr. Dong, disputing the above two plots of land and was awarded a victory by the People's Court of District 3.
Then the Ministry of Public Security sent a document to the High People's Procuracy in Ho Chi Minh City requesting cassation to cancel the first instance verdict.
In early 2024, the High People's Court in Ho Chi Minh City held a retrial and annulled the above first instance verdict. The value of appropriation in this case was determined to be 38.9 billion VND.
In the third case, Tran Qui Thanh and Tran Uyen Phuong lent 35 billion VND to Mr. Nguyen Van Chung (general director of DCB Surveying, Consulting, Design and Construction Co., Ltd.) by signing a fake contract of transfer from Mr. and Mrs. Lam Hoang gave Mrs. Tran Uyen Phuong 29 plots of land in An Lac ward, Binh Tan district.
The above land was previously purchased by Mr. Nguyen Van Chung from Mr. and Mrs. Lam Hoang, and the name transfer procedures have not yet been completed. Mr. Chung agreed to borrow with an interest rate of 3%/month.
However, when Mr. Chung prepared enough 35 billion VND to receive back the 29 plots of land, the defendants asked him to pay an additional 14 billion VND and not allow the property to be redeemed. The value of appropriation was determined to be more than 48 billion VND.
In the fourth case, Tran Qui Thanh, Tran Uyen Phuong, Tran Ngoc Bich lent 500 billion VND to Ms. Dang Thi Kim Oanh (Chairwoman of the Board of Directors of Kim Oanh Company) by signing a fake contract to transfer shares of Minh Thanh Company. agreement to transfer/promise to transfer Nhon Thanh project to Tran Uyen Phuong, Tran Ngoc Bich, TCS Company (a company belonging to Tan Hiep Phat Group) with an interest rate of 3%/month; Late payment interest rate is 4.5%/month, covered up by resale commitments.
By the time Ms. Dang Thi Kim Oanh's side prepared the full amount of 500 billion VND, Tran Qui Thanh's side used the excuse of violating the terms of the contract to lose the right to buy back and not be allowed to redeem the property.
The value of appropriation in this case is determined to be more than 880 billion VND (two projects). The total value of appropriation was determined to be more than 1,048 billion VND.
