The special amnesty was carried out on the occasion of the 79th anniversary of the National Day and the 70th anniversary of the Liberation of the Capital (10/10).
Subjects of special amnesty include persons who are serving fixed-term imprisonment sentences, persons sentenced to life imprisonment who have been reduced to fixed-term imprisonment, and persons who are temporarily suspended from serving their sentences.
In particular, a person who is serving a fixed-term imprisonment sentence or sentenced to life imprisonment who has been reduced to a fixed-term imprisonment to be proposed for special amnesty must fully meet the following conditions: Have progress, have a good sense of reform and be classified as serving a good or good prison sentence as prescribed; have served a prison sentence of at least 1/2 of the time in case of being sentenced to fixed-term imprisonment; have completely served the additional penalty of a fine and have paid court costs; have completed the obligation to return assets, compensate for damages, and other civil obligations to persons sentenced to imprisonment for corruption crimes...
Persons sentenced to fixed-term imprisonment who have served at least 1/3 of the time, persons sentenced to life imprisonment who have been reduced to fixed-term imprisonment who have served at least 13 years, are also proposed for special amnesty when: They have made great achievements during the time of serving their prison sentences; people with meritorious services to the revolution; people who are suffering from serious diseases and frequent illnesses; people aged full 70 years or older; have extremely difficult family circumstances...
15 cases were not eligible for special amnesty, including: Sentenced to imprisonment for treason to the Fatherland; the crime of operating to overthrow the people's administration; espionage, crimes of infringing upon territorial security; rioting; crimes of terrorism aimed at opposing the people's government...
Regarding special amnesty in special cases, the Government shall assume the prime responsibility for, and coordinate with the Supreme People's Court, the Supreme People's Army and relevant agencies in, compiling dossiers of persons proposed for special amnesty in special cases for submission to the President for consideration and decision.
Mr. Pham Thanh Ha, Deputy Chairman of the Office of the President, said that from 2009 to now, Vietnam has conducted 9 rounds of special amnesty for more than 92,000 prisoners, on the occasion of important events and major holidays of the country.
The special amnesty has helped tens of thousands of people enjoy the joy of leniency, soon return to reunite with their families, ready to rebuild their lives.
In fact, most of the people granted special amnesty have returned to their place of residence, stabilized their lives, and done honest business, and the recidivism rate is very low.
According to the 2024 special amnesty decision signed by President To Lam, people who are serving fixed-term prison sentences and people sentenced to life imprisonment who have been reduced to fixed-term imprisonment need to meet 7 conditions to be considered for special amnesty.
One of these is a person sentenced to imprisonment for corruption crimes who is forced to complete the obligation to return assets, compensate for damages, and other civil obligations.
At the press conference, the press asked whether it is possible to estimate the number of corruption offenders eligible for special amnesty consideration this year?
Lieutenant General Le Quoc Hung, Deputy Minister of Public Security, said that today the decision on special amnesty was announced, the next step will be to review detention facilities to determine which prisoners are eligible according to the President's decision.
Therefore, at this time, it is not possible to confirm how many prisoners who commit corruption crimes have been granted special amnesty. The exact number will be announced in the near future.
The press also questioned whether the case of Mr. Chu Ngoc Anh (former Minister of Science and Technology, former Chairman of the Hanoi People's Committee) sentenced to 3 years in prison in the Viet A test kit case is eligible for special amnesty consideration this year?
Deputy Minister of Public Security Le Quoc Hung said that Mr. Ngoc Anh is a prisoner serving his sentence at the prison of the Ministry of Public Security.
The Deputy Minister of Public Security stated that today the President's decision on special amnesty was announced. The authorities must review Mr. Chu Ngoc Anh's reform dossier in detail, then know whether he is eligible for special amnesty or not.
