Truong My Lan case: Total assets and evidence seized worth thousands of billions of dong

The Ho Chi Minh City Civil Judgment Enforcement Department has just sent a document to the High People's Court in Ho Chi Minh City providing information on the receipt of evidence and the amount of compensation paid by the parties in the Van Thinh Phat case.

Accordingly, the exhibits and money transferred by the Ministry of Public Security's Investigation Police Agency to the Ho Chi Minh City Civil Judgment Enforcement Department consisted of two phases. Regarding exhibits, phase 1 included documents on shares, including 23 share ownership books with more than 2.34 billion shares; 1,307 land use right certificates; 34 savings books with more than 617 billion VND; other electronic devices including mobile phones, CPU hard drives, desktop computers, laptops, etc.

Phase 2 includes 79 land use right certificates; 3 term savings cards at Vietcombank with a total amount of 38.6 billion VND, including 2 cards under the name of Chu Duyet Hang worth 31.9 billion VND, a card under the name of Ms. Truong My Lan worth 6.7 billion VND; two term savings cards at Vietcombank worth 2.5 billion VND, a savings book at Eximbank worth 10 billion VND.

Other exhibits include 1 Hermes handbag, 8 laptops, 10 phones, 5 hard drives, 3 digital receivers... According to the Ho Chi Minh City Civil Judgment Enforcement Department, the amounts of money include more than 1,786 billion VND and more than 26.6 million USD.

The amount of money paid by organizations and individuals to the Ho Chi Minh City Civil Judgment Enforcement Department is estimated to be more than VND2,464 billion and USD400,000. Of which, the amount paid during the first instance trial is VND390 billion; the amount paid after the first instance verdict (April 11) is more than VND2,073 billion and USD400,000.

Thus, the total amount of money currently held in the account of the Civil Judgment Enforcement Department of Ho Chi Minh City transferred by the Investigation Police Department of the Ministry of Public Security and deposited by individuals and organizations at the Department is more than 4,250 billion VND and 27 million USD (equivalent to 685 billion VND).

Previously, the Civil Judgment Enforcement Department of Ho Chi Minh City received a request on October 23 from Ms. Truong My Lan. The content of the request stated opinions, presentations, and requests related to the organization of the enforcement of the civil judgment according to judgment No. 157/2024/HS-ST (Van Thinh Phat case, phase 1), judgment No. 504/2024/HSST dated November 17, 2024 (Van Thinh Phat case, phase 2), including prioritizing the enforcement of judgments for victims who are bondholders in phase 2, the order of handling seized and frozen assets, the method of enforcement of judgments for certain assets, etc.

Notably, in this petition, Ms. Truong My Lan said that for some assets that are not related to the case, not mortgaged, not seized, and assets lent by friends to sell or transfer in order to have more money to overcome the consequences, the family is allowed to proactively seek partners and customers to continue developing or transferring.

Those assets are 18% of shares in Vietcombank Tower building, Capital Place office building, 65 unsecured assets for debt obligations currently held and managed by OCB Bank (including 6A Binh Chanh project).

According to Ms. Lan, some assets originated before 2012, using the family’s accumulated business money over the past 50 years. Some of these assets are mortgaged at SCB Bank, some are being seized and are in the list and appendix of the first instance judgment.

This part of the property was partly formed from the time of the grandparents, so it is recommended that the Ho Chi Minh City Civil Judgment Enforcement Department consider and handle the final judgment. In case the handling of the above assets is sufficient to remedy the consequences, the authorities will request that these assets be released from the seizure, kept as property, and used as a livelihood for the family.
