The horrific acciden.t occurred at around 6:30 p.m. on June 15. A Jeep with license plate 51K-314.xx, driven by Nguyen Bao Hoang (born in 1994, resident of Binh Duong), was traveling on Kinh Duong Vuong Street when it suddenly lost control, crashed through the median strip, and veered into the motorbike lane. The car collided with many pedestrians, dragging a motorbike under it before stopping on the sidewalk.
The consequences caused Ms. NTT (50 years old, living in Tan Binh district) and her biological mother to di.e on the spot. Another man was also seriously injured. What made the public angry was that according to witnesses, immediately after the collision, two people got out of the car and quickly left the scene, leaving the victims behind.
Initially, the authorities identified the Jeep as belonging to Mr. LHT, a businessman in Ho Chi Minh City. However, Nguyen Bao Hoang told investigators that he had bought the car and had used it for a while.
"Technical problem" statement and unexpected test results
Regarding the events before the incident, Hoang stated that on the afternoon of June 15, he and a group of friends gathered to eat and drink at a pub. At around 6:10 p.m., Hoang left alone by car. When he reached Kinh Duong Vuong Street, about 3km from the pub, the car suddenly encountered a technical problem, causing Hoang to lose control and cause the acciden.t.
After the incident, Hoang panicked and called his friend to pick him up so he could leave the scene. He then bought things at a supermarket and took a bus to Dong Thap province. However, his escape was not long, and under the urging of his family and the authorities, Hoang turned himself in to the local police.
The most notable information from Ho Chi Minh City Police is that Nguyen Bao Hoang's bloo.d test results showed negative for both alcohol and banned substances. This result surprised many people, because it was different from the initial speculation. However, the authorities emphasized that the test sample was taken almost a day after the incident. Regarding the incident, lawyer Nguyen Ngo Quang Nhat (Ho Chi Minh City Bar Association) said that the Law on Road Traffic Order and Safety strictly prohibits fleeing after a collision to avoid responsibility. The driver must remain at the scene until the police arrive, except in urgent cases such as emergency or life-threatening situations (but must immediately report to the nearest agency).
The fact that Nguyen Bao Hoang did not stay at the scene without a clearly stated legitimate reason can be considered an act of fleeing to avoid responsibility. This act, or intentionally failing to help the victi.m, can be prosecuted under Article 260 of the 2017 Penal Code on "Crime of violating regulations on road traffic participation". The penalty can range from 3 to 10 years in prison, along with a ban on holding a position, practicing a profession or doing certain work from 1 to 5 years.
Lawyer Nguyen Hong Linh (Ho Chi Minh City Bar Association) added that during the investigation, the authorities will clarify whether the driver violated any other road traffic safety regulations. This includes: whether he had a valid driving license, whether the vehicle was in good technical condition, and whether he violated any other traffic safety regulations, in addition to the use of alcohol or banned substances (even if the initial test result was negative).
If there is an act of violating road traffic safety regulations and causing the deat.h of 2 people, the driver will be prosecuted for "Crime of violating road traffic regulations" with a prison sentence of 3 to 10 years.
