On the morning of January 23, regarding the incident in which a male shipper was beate.n t.o deat.h by 3 people due to a dispute over an order of 375 thousand VND, which occurred in Da Nang, the Hoa Vang District Police (Da Nang City) informed that they are temporarily detaining 3 suspects related to the fight that led to the deat.h of Mr. Tran Thanh (Hoa Phuoc Commune, Hoa Vang District), who was the delivery person for Ms. Tr.Th. in Giang Nam 2 Village, Hoa Phuoc Commune.

Based on the investigation results, if it is determined that the suspects used a dangerous weapo.n (helmet) to impact the vital area (head) of the victi.m with the intention of ending his life or were fully aware that his actions could lead to deat.h, this act will be prosecuted for murde.r under Article 123 of the Penal Code. This crime has the highest penalty of deat.h.

In cases where there is insufficient evidence to prosecute for murde.r, but there is evidence of intentional injury resulting in deat.h, the subjects will be prosecuted under Clause 4, Article 134 of the Penal Code, with a penalty of 7 to 14 years in prison.

According to the lawyer, the investigation agency needs to clarify the motive and circumstances of the incident. According to information published by the authorities, in this case, the conflict arose from a small amount of mone.y that the customer had not paid, along with a "bad star" rating that caused the victi.m to be fined and suffer financial losses. The victi.m's actions may have been spontaneous in a moment of anger, but cannot justify the violent behavior that led to Mr. Thanh's deat.h.

"If it is proven that the suspects' actions were of a hooligan nature, not only intentionally causing injury but also with the motive of taking the victi.m's life, then the most severe punishment must be applied.

In addition to criminal liability, the suspects must compensate the victi.m's family for all damages, including funeral expenses, compensation for mental damage and chil.d support (if any), the lawyer analyzed.

At the same time, the lawyer said that the authorities also need to clarify the motive and role of the gir.l who bought the goods? In addition to clarifying the behavior that led to the victi.m's deat.h and the fault factor in carrying out the behavior, the prosecuting agency will also clarify whether the motive for the incident originated from the delivery of the goods or not.

According to the lawyer, in the case that this person has the same intention to commit the crime, and the same desire for the defendants to beat the victi.m, this person will be treated as an accomplice, the mastermind or accomplice in the crime.
