Case of male student beaten with traumatic brain injury: More hot information, 18 years in prison?

The incident of a male student being beaten by a group of teenagers, causing a traumatic brain injury, has caused public outrage in recent days. The subjects will have to pay the price for their actions.

On March 28, Dong Nai Province Police arrested 6 suspects related to the case of male student NMT (17 years old, from An Giang, temporarily residing in Tan Hoa Ward, Bien Hoa City) who was assaulted and hospitalized. At the investigation agency, the suspects all admitted their actions and explained the reason for the crime.

Initially, the police determined that it was due to a love affair. Specifically, T. and PBN (16 years old, residing in Tan Hoa ward) both knew a female friend named Th. and the two had a conflict with each other. After that, PBN called Nguyen Van Nguyen (20 years old), Nguyen Van Thang (18 years old), PVK (16 years old), TVNH (16 years old) and NTĐ. (16 years old, all residing in Bien Hoa city) to bring dangerous objects to find T. to talk.

At noon on March 27, PBN's group discovered T. walking on an alley in Ward 4A, Tan Hoa Ward, and immediately attacked him in the head and back of the neck, causing T. to collapse on the spot. The victim had a seizure and was taken to Thong Nhat General Hospital for emergency treatment immediately afterwards.

Following the case, Dr. Lawyer Dang Van Cuong said: The behavior of the subjects is very hooligan, reckless, showing contempt for the law and showing signs of murder.

Initial verification results and shown through the clip determined: At around 11:00 a.m. on March 27, the male student finished school and walked to the alley near the school to go home when he was suddenly attacked by a group of teenagers.

One of them used an iron rod to repeatedly hit the victim's head, causing him to collapse in the middle of the street and have convulsions. After beating the 10th grade male student, causing a traumatic brain injury, the group of teenagers fled but were arrested by detectives.

Lawyer Dang Van Cuong said that according to the law, the iron bar is a dangerous weapon and the victim's head is a vital area, a person from 16 years old is old enough to bear criminal responsibility, so this act will be handled as murder according to Article 123 of the Penal Code and Precedent No. 47/2021/AL of the Supreme People's Court.

"A normal person must be aware that using an iron rod of that size to repeatedly hit the head of a 16-year-old victim can completely take the victim's life. In fact, the victim suffered a traumatic brain injury, a serious injury, so it is eligible to apply the Judicial Council's Precedent 47/2021/AL to handle the crime of murder," lawyer Cuong analyzed.

According to the lawyer, this is a serious and very worrying case, because both the perpetrator and the victim are only 16 years old, and the crime is very serious. Through the clip that is spreading on social networks, the behavior of the subjects is very aggressive, continuously attacking the head, causing the victim to collapse on the street, convulsing, scaring those present.

"With such behavior, the investigation agency will conduct procedures to initiate a criminal case, prosecute the accused to handle the subjects who beat the victim for murder according to Clause 1, Article 123 of the Penal Code with a penalty of imprisonment from 12 to 20 years, life imprisonment or death penalty," lawyer Cuong added, because at the time of committing the crime, the subjects were 16 years old but not yet 18 years old, so the penalty for these subjects will not exceed 18 years in prison.

Experts also said that this is one of the worrying incidents of violence against high school students outside of school grounds. Therefore, in addition to clarifying the cause of the incident, the behavior of the subjects and the consequences caused to the victims for society, it is also necessary to strengthen measures to effectively propagate the law, educate ethics and life skills for students to avoid similar incidents from happening.
