Therefore, at about 4 p.m. on October 20, 2024, Trang was driven by Mr. V. from Dong Thap province to Ho Chi Minh City. HCM. While resting along the road, Trang bought coffee and put cyanide poison in it and gave it to Mr. V. to drink.

After 3 minutes of using coffee, Mr. V. fell into a state of fatigue, stopped the car on the side of the road to rest. When Mr. V. lost consciousness, Trang asked people to help him into the passenger seat. After that, Trang drove Nhan to Ho Chi Minh City. HCM. At 8 p.m. on the same day, knowing that Mr. V. had died, Trang drove the car to her room in District 7 (Ho Chi Minh City). Ho Chi Minh City). Here, Trang poured all the remaining cyanide powder into the non-mourning water tank.

At dawn on October 21, 2024, Trang drove a car carrying thousands of people in the direction of Lam Dong. At 2 p.m. on the same day, when the car was on Bao Loc Pass, Trang drove a car into the ravine to free herself. However, because Trang was wearing a seat belt, the car airbag was deployed, so it was only slightly rubbed.

The incident was reported to the Board of Directors of Lam Dong Provincial Police. Noticing that there were many unusual circumstances, Colonel Dinh Xuan Huy, Deputy Director, Head of the Investigating Police Agency immediately went to the scene to direct the Criminal Police Division to coordinate with the Bao Loc City Police and professional units to urgently investigate.

According to the provisions of the Law on Chemicals 2007 and Decree No. 113/2017/ND-CP of the Government, cyanhydric acid and dissolved cyanide salts do not belong to the group of prohibited chemicals but belong to the group of chemicals subject to conditional production and business. All individuals and organizations when buying and selling substances of the cyanide group in general must strictly comply with the provisions of law. Illegal trading acts that do not comply with safety conditions will be strictly handled in accordance with the law.

In addition, according to Decision No. 1971/1999/QD-BKHCNMT dated November 10, 1999 of the Ministry of Science, Technology and Environment, cyanhydric acid and its dissolved cyanide salts are very toxic substances, only about 50 mg can harm a person.

Thus, from the above regulations, it can be affirmed that compounds belonging to the cyanide group are toxic substances, although they are not strictly prohibited but belong to the group of chemicals subject to conditional business. If they do not comply with the conditions for buying and selling drugs, illegal traders can be handled for the crime of illegal trading of poisons according to Article 311 of the Criminal Code 2015.

Specifically, this Law stipulates that those who illegally produce, store, transport, use or trade in inflammable substances and poisons shall be sentenced to 1-5 years in prison. In case of framing circumstances such as causing death, causing damage to the health of others by 61% or more, or causing property damage from 100 million VND to less than 500 million VND, the applicable fine is 3-10 years in prison.

For cases of serious or particularly serious crimes as prescribed in Clauses 3 and 4 of this Article, the highest penalty bracket that can be applied to toxic drug dealers is 15-20 years of imprisonment or life imprisonment.

Thus, in addition to Trang's legal responsibility, the investigating agency will also apply professional measures to find the person who sold cyanide, creating conditions for the suspect to commit acts with signs of the crime of cyanide. If it is determined that the chemicals sold to Trang are poisonous but still carry them out, that person may be criminally handled for the crime of illegally trading in poisons with a penalty of 3-10 years in prison.
