At the police office, Tung confessed that at more than 6 o'clock on August 2, he drove a pickup truck BKS 47C-286.xx from his house to the Traffic Department of the Dak Lak Provincial Police to pay a fine for administrative violations. When driving the car to Hoa Dong commune (Krong Pak district), this driver overtook some cars in front of him and lost his direction.

Arriving at the section passing through Ea Tu commune, Buon Ma Thuot city, Tung's car suddenly hit the motorcycle BKS 47F1-476.xx head-on. When he learned that the 3 people on the motorcycle had no signs of life, the pickup truck driver called his relatives to take them to the Hoa Dong Commune Police headquarters to report and work.

The unfortunate victims who died in the accident include: Mr. V.V.H. (42 years old), Ms. Q.T.L. (37 years old) and son V.V.K. (13 years old) living in Ea Dar commune (Ea Kar district, Dak Lak).

Pursuant to Article 260 of the Criminal Code 2015 (amended by Clause 72, Article 1 of the Law amending the Criminal Code 2017) as follows:

Crime of violating regulations on road traffic participation

1. Those who participate in road traffic and violate regulations on road traffic safety and cause damage to others in one of the following cases shall be subject to a fine of between VND 30,000,000 and VND 100,000,000, non-custodial reform for up to 03 years or a prison term of between 01 and 05 years:

a) Causing death;

b) Causing injury or harm to the health of 01 person with a bodily injury rate of 61% or more;

c) Causing injury or harm to the health of 02 or more persons with a total bodily injury rate of between 61% and 121%;

d) Causing property damage of between VND 100,000,000 and less than VND 500,000,000.

3. Committing the crime in one of the following cases, the offenders shall be sentenced to between 07 and 15 years of imprisonment:

a) Causing the death of 03 or more people;

b) Causing injury or harm to the health of 03 or more persons with a total bodily injury rate of 201% or more of these persons;

c) Causing property damage of VND 1,500,000,000 or more.

5. Offenders may also be banned from holding certain posts, practicing certain professions or doing certain jobs for between 01 and 05 years.

Accordingly, in case the truck driver overtakes the vehicle in contravention of regulations, causing a traffic accident that kills 03 people, he may be prosecuted for criminal liability from 07 years to 15 years in prison. In addition, the offender may also be banned from holding certain positions, practicing certain professions or doing certain jobs from 01 to 05 years.
