The People's Procuracy of Ho Chi Minh City has proposed a sentence for Mr. Tran Qui Thanh (born in 1953, residing in Vinh Phu ward, Thuan An City, Binh Duong province - former Director of Tan Hiep Phat Trading and Services Co., Ltd.) and Her two daughters, Tran Uyen Phuong (born in 1981) and Tran Ngoc Bich (born in 1984), both residing in Vinh Phu ward, Thuan An city, Binh Duong province) were charged with the crime of "Abuse of trust and appropriation of property".
Accordingly, the Procuracy proposed a sentence of 9-10 years in prison for defendant Tran Qui Thanh. Proposing a sentence of 5-6 years in prison for defendant Tran Uyen Phuong and 4-5 years in prison for defendant Tran Ngoc Bich.
According to the Procuracy, based on the statements of the defendants, there is a basis to determine that during the period from 2019 to 2020, Mr. Tran Qui Thanh, Ms. Tran Ngoc Bich, Ms. Tran Uyen Phuong, through a broker, gave them /Mrs. Lam Son Hoang, Nguyen Huy Dong, Nguyen Van Chung, Dang Thi Kim Oanh borrowed money.
This money is loaned at an interest rate of 3%/month but requires asset/project owners to sign a contract to transfer assets/shares of the project to hide the nature of the loan.
When the borrower fully fulfilled its obligation to repay principal and interest according to the agreement and commitment to resell, Mr. Thanh and his son cited reasons for not returning the property to the property owner such as late payment, request demand to pay more money to redeem the property, giving the reason that the victims violated the contract so they lost the right to buy back the property and were not allowed to redeem the property. Accordingly, the total value of the assets that the defendants appropriated from the four victims is 1,048 billion VND.
The Procuracy also said that defendant Tran Qui Thanh must bear the main responsibility in this case, followed by defendants Tran Uyen Phuong and Tran Ngoc Bich.
Those who act as "brokers" and bridges between Mr. Thanh and the victims such as Ms. Nguyen Hoang Phu, Doan Nguyen Minh Hoang, and Nguyen Phi Long are considered accomplices for helping Mr. Tran Qui. Thanh and his accomplices appropriated property. Therefore, there is no basis for criminal prosecution of these people.
Regarding the transactions with Ms. Dang Thi Kim Oanh, Mr. Thanh basically agreed with Ms. Kim Oanh's requests but asked the court to consider the exact number. Regarding the claim of more than 531 billion in damages due to the loss of "business development opportunities" of the two projects Minh Thanh and Nhon Thanh from the time the assets were appropriated, Mr. Thanh disagreed and requested a settlement. decided according to the law.
Defendant Tran Uyen Phuong also agreed to receive the money back and cancel the transactions; Defendant Tran Ngoc Bich said he wanted to find a solution to resolve everything quickly.
During questioning in court, the Procuracy determined that there was enough basis to determine that defendant Thanh lent money to the victims without transferring assets and asked if the defendant was aware that his behavior was lending for interest or not. ? Defendant Thanh replied: "At first the consciousness was buying and selling, then the defendant changed, the defendant saw that the defendant was wrong and the defendant accepted the jury's point of view and asked the court to consider it."
Previously, at the trial on April 23, the victim Dang Thi Kim Oanh, Chairman of the Board of Directors of Kim Oanh Real Estate Group, applied for trial in absentia. In the application, Ms. Dang Thi Kim Oanh requested the court to force the defendants to return 100% of the shares of Minh Thanh Company and the entire residential and service area project in An Phuoc commune, Long Thanh district, Dong Nai province to Kim Oanh Dong Nai Company.
Along with that is the entire Nhon Thanh residential area project in Phuoc An commune, Nhon Trach district, Dong Nai province for Thuan Loi Company; Records and documents related to Minh Thanh Company, Minh Thanh project, Nhon Thanh project. In addition, Kim Oanh's side also requested compensation for damages due to loss of "business development opportunities" from the time the property was appropriated until the time the case was brought to trial, amounting to 531 billion VND.
