Initial information may determine that the taxi driver violated regulations on stopping and parking on the road.

Specifically, according to point a, point d, clause 3, Article 18 of the 2008 Road Traffic Law, when stopping or parking a vehicle, the driver must "Signal to notify other vehicle drivers" and "Do not open the vehicle door, leave the vehicle door open or get out of the vehicle without ensuring safety conditions".

Pursuant to Point a, Clause 1, Article 260 of the 2015 Penal Code, amended and supplemented in 2017, the act of opening a car door without ensuring safety conditions, leading to the death of a taxi driver, constitutes a crime of violating regulations on road traffic participation. The penalty is a fine of 30 to 100 million VND, non-custodial reform for up to 3 years, or imprisonment from 1 to 5 years.

In addition to being criminally responsible, the taxi driver must also be responsible for compensating for material and spiritual damages to the first-line heirs of the victim. "Based on the provisions of Article 591 of the 2015 Civil Code, the victim's family is allowed to keep all invoices and documents related to the costs of treatment, burial, etc. of the victim; in case the victim is obliged to provide support, it is necessary to provide documents proving this issue" - lawyer Phung Huyen noted.

Therefore, it is necessary to clearly verify factors such as: alcohol concentration, speed, driver's license, vehicle registration... to clarify whether or not the driver of the white car is responsible for this collision. In case of violation, it is very likely that the driver of the white car will be jointly held criminally responsible with the taxi driver who opened the car door causing the collision. If it is determined that the driver of the white car was driving in accordance with regulations, the collision will be considered an "unexpected event" and will not be held responsible.

At the same time, the authorities must also clearly identify similar factors such as traffic speed, driving license, alcohol concentration... of the accident victim when participating in traffic to serve as a basis for determining fault in the collision according to regulations.
