Billionaire lawyer Gerard "takes the hit", bringing elements of extortion and fake marriage into the lawsuit

The long-standing scandal between Dam Vinh Hung and Bich Tuyen and her husband has attracted public attention. After the California Supreme Court (USA) rejected the singer's request to withdraw the lawsuit, the lawsuit has become even more tense and unpredictable.

Mr. Dung Taylor explained that if the defendant files a counterclaim that has not been resolved, the court has the right to refuse the plaintiff's request to withdraw the lawsuit, to ensure that the defendant's counterclaim is resolved.

He cited that on December 2, Dam Vinh Hung's side filed a request to withdraw the lawsuit, which was also the time when Mr. Gerard Williams - singer Bich Tuyen's husband filed a cross-suit.

The court has the right to reject the plaintiff's request to dismiss the lawsuit, Dam Vinh Hung, to ensure that the defendant's counterclaim, Mr. Gerard Williams, is resolved.

Accordingly, it can be seen that the Supreme Court of California (USA) has only received Dam Vinh Hung's lawsuit but has not yet approved the lawsuit, the lawsuit file is still pending resolution.

Mr. Dung Taylor added that on December 13, Dam Vinh Hung's side signed a lawyer change paper with the signature of lawyer Tu Huy Hoang and Dam Vinh Hung's signature.

Mr. Dung Taylor also affirmed that the court's rejection of Dam Vinh Hung's request to withdraw the lawsuit was due to the singer's initiative: "Because Dam Vinh Hung asked to cancel the lawsuit, the court rejected the request to withdraw the lawsuit. This could be a counterattack from the male singer and a change in strategy. So it can be said that Dam Vinh Hung "had his request to withdraw the lawsuit rejected by the court" rather than "had his request to withdraw the lawsuit rejected by the court".

When asked if the content of the lawsuit had changed after changing lawyers, Mr. Dung Taylor said that the content of the original lawsuit still existed, because the court rejected Dam Vinh Hung's request to cancel the lawsuit.

The fact that the lawsuit was reinstated has made the public afraid that in the 34-page counterclaim filed by billionaire Gerard Williams, there is a lot of evidence that is unfavorable to singer Dam Vinh Hung.

According to singer Bich Tuyen, singer Dam Vinh Hung sent a letter demanding compensation from billionaire Gerard Williams of 15 million USD. "In fact, if Dam Vinh Hung's side asked Gerard Williams to demand compensation of 15 million USD (about 381 billion VND), the singer would not sue. But Gerard Williams found the request unreasonable because the incident was not our fault at all," the singer said.

According to Mr. Dung Taylor, the 34-page lawsuit file provided to him by Mr. Gerard Williams included the element of extortion. Specifically, Dung Taylor said: "Based on an event from 2006, the claimant was prosecuted for extortion when demanding compensation before the lawsuit that was too high, unreasonable with the injury and income. Thereby, Mr. Gerard Williams's law firm included the element of extortion in the file to investigate whether Dam Vinh Hung's lawsuit was extortion or not?".

It is known that with the incident of not dying, 15 million USD is a very large compensation claim. Through the accusatio.n from Mr. Gerard Williams, singer Dam Vinh Hung may have to prove that his income is suitable for this compensation amount.

The lawyer representing Mr. Gerard also asked the court to consider Dam Vinh Hung's US permanent residency status obtained through the singer's marriage to show producer Lien Pham.

Mr. Dung Taylor also said that in the 34-page file of billionaire Gerard Williams, Dam Vinh Hung's side withdrew the lawsuit because he did not want to make public the income tax documents.

Currently, Dam Vinh Hung’s representative in the lawsuit is lawyer Tu Huy Hoang. Mr. Dung Taylor also commented that this is a Vietnamese lawyer who is knowledgeable about American law and has a high success rate in previous cases. However, in order for singer Dam Vinh Hung to win the lawsuit, lawyer Tu Huy Hoang will also have to prove that billionaire Gerard Williams’ accusations of tax evasion and extortion against Dam Vinh Hung are baseless.

Previously, according to singer Bich Tuyen's revelation, at the time of the incident, she and her husband were very worried about Dam Vinh Hung and they proactively paid all the hospital fees for the male singer's medical treatment in the US, about 30,000 USD.

After that, after finishing the treatment, Dam Vinh Hung personally sent his thanks and confirmed to Bich Tuyen and her husband that his health had recovered after the incident.
