Around February 1994, Ms. H., as Director of Quyet Thang Company, signed many contracts to process and purchase more than 1.5 million tons of rice with the Central Food Company 3 Ho Chi Minh City branch (Vinafood III). During the contract implementation process, Ms. H. used a large amount of rice deposited by her partner in her warehouse to sell to other businesses, or mortgage it to the bank, appropriating more than 24 billion VND.

In addition, Ms. H. also bought 10,000 tons of fertilizer from Vinafood III but did not pay in full, appropriating an additional 2 billion VND in goods. Similarly, the defendant signed a contract to sell more than 20,000 tons of rice to the National Reserve Department - Branch I, worth more than 40 billion VND in total and received an advance payment of more than 28 billion VND from the partner. However, she only partially fulfilled the contract, did not refund the excess money she received, and appropriated more than 11.2 billion VND from this unit.

The defense lawyer for defendant H. presented a series of mitigating circumstances for his client, such as sincere testimony, good character, poor health, and difficult family circumstances, hoping the court would consider it.
