According to Decree 168 that has just been issued, the authorities will strictly handle cases of deliberate traffic violations, or violations and then evasion of multiple-choice will be dealt with much more severely than before.

Decree 168/2024/ND-CP stipulates penalties for administrative violations of traffic order and safety in the field of road traffic; deduct points, restore driving license points, effective from January 1, 2025.

According to this Decree, the driver of the vehicle goes in the opposite direction, walking on the sidewalk (except for the case of driving the vehicle through the sidewalk to enter the house or office); failing to obey the orders of traffic signals; driving motorcycles without number plates; affixing license plates that are not in accordance with the vehicle registration certificate or attaching license plates not issued by competent agencies will be fined from 4-6 million VND.

A fine of 8-10 million VND will be applied to drivers who swerve and hi.t hammocks on the road; using anti-vehicle or other objects to sweep onto the road while the vehicle is running; driving vehicles in groups of 2 or more vehicles exceeding the prescribed speed; using horns, roaring throttles (braces) continuously in densely populated areas...

According to Security & Capital, Due to the high level of penalties for traffic violations, in fact, there are many individuals who violate when sanctioned by functional forces who deliberately do not pay fines, "abandon things and run for people".

Regarding the sanction for this act, lawyer Le Hong Van - Hanoi Bar Association said that according to Article 74 of the amended Law on Handling of Administrative Violations, the statute of limitations for enforcement of decisions on sanctioning administrative violations is 1 year, from the date of issuance of the decision, beyond this time limit, such decision will not be enforced. Except for cases where the sanctioning decisions apply the sanctioning form of confiscation of material evidences and means of administrative violations and remedial measures, material evidences and means must still be confiscated and remedial measures must be applied.

In case the sanctioned individual or organization deliberately evades or delays, the above-mentioned statute of limitations shall be counted from the time of termination of the act of evasion or delay. Therefore, if the violator evades and does not pay the fine but abandons the vehicle, the statute of limitations for enforcement of the sanctioning decision shall be counted from the time of termination of the act of evasion or delay.

Upon the expiration of the above time limit, the individual still fails to perform his/her obligations, he/she may be coerced to execute the sanctioning decision in the following forms: Deduction of part of salary or income, deduction of mone.y from the violator's account; Distraint of assets with a value corresponding to the amount of fines for auction; Collecting mone.y and other assets of persons subject to enforcement of decisions on sanctioning administrative violations held by others in case the violators deliberately disperse their assets; Forcible remedy of consequences as prescribed.

Thus, if an individual who commits a traffic violation deliberately fails to pay a fine, leaves his vehicle still has to pay a fine according to the administrative sanctioning decision, if he does not accept the sanctioning decision, he may be coerced.

Colonel Nhat took as an example, car drivers who violate the alcohol concentration at level 1 in addition to administrative sanctions will be deducted 4 points, violations at level 2 will be deducted 10 points, and at level 3 will be deprived of their license for 22-24 months. Some other behaviors such as not obeying traffic signals, not obeying the orders of traffic operators, driving vehicles in the opposite direction will be deducted 4 points of driving license.
