In order to prevent the situation of promoting products for money, the Ministry of Culture, Sports and Tourism has recently submitted to the Ministry of Justice for evaluation the outline of a proposal to develop a Law amending and supplementing a number of articles of the Law on Product Promotion - adding regulations on activities of carriers (usually artists, celebrities or influential people on social networks) promoting products.
People who convey products promoting influential products are people who are active in the field of art, celebrities or people who have social media accounts with a large number of subscribers and followers.
"The activities of an influential product carrier must satisfy the following requirements: there must be a written agreement with the organization or individual whose products, goods or services are advertised, and must be agreed and confirmed by that organization or individual in the product promotion content before implementation, when posting opinions and feelings about the use of goods and services on a specific social networking site, clearly stating the proof of the use of the product directly."
Accordingly, the Ministry of Culture, Sports and Tourism proposes that artists, KOLs, etc., when selling and advertising goods, must have real experiences and true illustrations. There are also specific regulations for services and items such as medicines, functional foods, milk, medical examination and treatment services, etc.
The content of the Law amending and supplementing a number of articles of the Law on Advertising focuses on 4 policies
Policy 1, the participation of foreign suppliers and the provision of cross-border advertising services in the Vietnamese advertising market.
Policy 2, relevance and truthfulness of advertising content.
Policy 3, limit the amount of advertising on TV shows.
Policy 4, the responsibility of the carrier of advertising products.
"Advertisement of functional foods: must have uses and effects; it is recommended that this food is not a medicine and has no effect of replacing medicine, the writing must be clear, with a color that contrasts with the background color. Do not use images, equipment, costumes, names, letters of medical units, medical facilities, doctors, pharmacists, medical staff, letters of thanks from medical doctors, pharmacists" .
In addition, the draft replaces the content of Clause 2, Article 19 as follows:
Drug advertisement must have the following information: Name of drug; Active ingredients or herbal ingredients in the approved package insert; Point; How to use; Dosage; Contraindications, recommendations for special subjects; Name of the drug manufacturing establishment; The instruction "Read the user manual carefully before using".
Advertising functional foods: must have uses and effects; recommends "This food is not a medicine and has no effect as a substitute for medicine"; The writing must be clear, with a color contrasting with the background color. In particular, do not use images, equipment, costumes, names, letters of medical units, facilities, doctors, pharmacists, medical staff, thank you letters from patients, articles of doctors, pharmacists, medical staff to advertise food.
Advertisements for chemicals and insecticidal and germicidal preparations for household and medical use must contain the following contents: Name; Features and uses of insecticidal and germicidal chemicals and preparations for household and medical use; Name of the organization or individual responsible for bringing the product to market; Recommended "Read instructions for use carefully before use" or "Limit the scope of use to products that use chemicals in the restricted list".
Advertisements for milk products and nutritional supplements for children must contain the following contents: Name of milk products and nutritional supplements for children; Name of the organization or individual responsible for bringing the product to market; recommends "Breast milk is the best food for the health and comprehensive development of infants" and "This product is a complementary food and can be eaten with breast milk for babies over 6 months old".
An advertisement for medical examination and treatment services must contain the following contents: Name of the medical examination and treatment establishment where it is licensed to operate; The main scope of professional and technical activities is stated in the operation license or practice certificate which has been licensed by a competent medical authority.
Before that, there were artists selling, advertising about virtual money, even introducing spiritual products or telling each other on Facebook to see fortune-telling online. MC Cat Tuong in a dairy advertisement confidently listed a series of divine uses that are similar to medicines for osteoarthritis, which can make users immediately get rid of the disease after only a short time. Another time, she also posted a "horoscope" ad on the official Facebook page.
