The case of a grandson and his friend killin.g his grandmother and setting fire to a house in Hung Yen is shocking public opinion. The Investigation Police Agency (Hung Yen Provincial Police) has issued an emergency arrest warrant and temporary criminal detention.
At around 6:20 a.m. on March 19, receiving a fire report from the people at the house of Ms. Nguyen Thi L. (born in 1952 in Da Hoa village, Binh Minh commune, Khoai Chau, Hung Yen), Binh Minh commune police arrived at the scene to coordinate with the people to put out the fire. During the fire extinguishing process, the authorities discovered that Ms. L. had passed away in the pond behind the house, with many wounds on her body (suspected to be caused by sharp objects). Determining that there were signs of a murde.r crime, the Director of Hung Yen Provincial Police established a special case, directing the forces to investigate and arrest the criminal.
After more than 10 hours, the police force broke up the case and arrested two suspects who kille.d Ms. Nguyen Thi L.: Nguyen Chu Thanh Tu (born in 2009 in Da Hoa village, Binh Minh commune, Khoai Chau district), Ms. L.'s grandson, and Le Gia Bao (born in 2010, residing in Phuoc Hiep quarter, Gia Dinh ward, Trang Bang town, Tay Ninh province).
According to the investigation results, because he was often scolded by his grandmother for playing too much, not studying, and coming home late many times, Tu had the idea of attacking his grandmother. After that, Tu hired Bao (a friend he met while playing online games) for 5 million VND, paying all the travel and food expenses for Bao to attac.k his grandmother.
At around 3:30 a.m. on March 19, Bao went to Mrs. L's house to meet Tu. Tu gave Bao a 'cold item', then the two climbed over the wall into Mrs. L's house. When they arrived, Tu made a noise to wake Mrs. L. up and went down to the kitchen, then Bao used a cloth shirt to tie her neck. When Mrs. L. resisted, Bao continued to use the 'cold item' Tu gave her to 'impact' her many times, causing her to fall down and lie motionless. Tu searched Mrs. L's pocket, took 180,000 VND, then together with Bao, dragged Mrs. L. and drowne.d her in the pond behind the house. Mrs. L. then lost her life.
After committing the crime, the two subjects wiped the bloo.d stains in the kitchen, Bao took the motorbike from Mrs. L's house and left. Tu stayed behind to set fire to the kitchen and Mrs. L's house to erase the traces.
Expressing his opinion on the case, Lawyer Nguyen Anh Thom - Head of Nguyen Anh Law Office (Hanoi Bar Association) said that this case has shocked public opinion because of the cruelt.y of the subjects despite their very young ag.e. This is also a warning bell for parents and schools to manage and educate children in their teens, especially now that social networks have many negative aspects that affect the psychology and behavior of children.
According to Lawyer Thom, the two suspects in the case were born in 2009 and 2010. According to the law, the subjects who committed the crime were all between the ages of 14 and under 16. The subjects' actions were particularly serious, violating many subjects protected by law in the Penal Code (CPC), which are the right to life and the right to own property of citizens.
Pursuant to Article 12 of the Penal Code, the ag.e of criminal responsibility stipulates that persons from 14 years of ag.e to under 16 years of ag.e must bear criminal responsibility for very serious crimes and especially serious crimes specified in one of the following articles: 123, 134, 141, 142, 143, 144, 150, 151, 168, 169, 170, 171, 173, 178, 248, 249, 250, 251, 252, 265, 266, 286, 287, 289, 290, 299, 303 and 304 of this Code.
Considering the behavior of the subjects showing aggressive hooliganism, using 'sharp objects' to harm the victi.m, the grandmother, then appropriating 180,000 VND of property and setting fire to the house, they committed 3 crimes: Murde.r, Robbery and Destruction of property. The crimes and penalties are stipulated in Points d, e, m, n, Clause 1, Article 123, Clause 1, Article 168 and Article 178 of the Penal Code.
For the crime of Property Destruction, if the result of the property damage assessment is from 200,000,000 VND to less than 500,000,000 VND, the subject will be criminally prosecuted according to the provisions of Clause 3, Article 178 of the Penal Code (very serious crime).
If there is a basis to determine the time of the crime, the subjects were between 14 and under 16 years old, according to the provisions of Article 101 of the Penal Code, the maximum penalty is not more than 12 years, even in cases of multiple crimes, Lawyer Thom commented.
