N. was carrying his younger brother on a bicycle on a village road when he was hit by a motorbike going in the same direction, resulting in 90% physical injury. The father carried N. to court to seek justice.
Chau Thanh District People's Court (Soc Trang province) invited the parties to attend the meeting to examine the submission, access, disclosure of evidence and mediation to resolve the civil case on "Compensation for non-contractual health damage".
The plaintiff is Mr. Doan Duc Linh (42 years old, residing in Phu Tan commune, Chau Thanh district). The defendant is HTTH (born March 10, 2008, residing in the same locality) and the representative is Mrs. Tran Thi Bich Thuy (mother of H.).
According to the case file, at around 12:15 p.m. on January 21, 2023 (ie noon on the 30th of Tet), H. was driving a motorbike with license plate 83S2-69xx on an inter-hamlet road in Phu Tan commune. When passing through Phuoc Quoi hamlet, Phu Tan commune, the motorbike driven by H. collided with a bicycle driven by D.NN (11 years old, Mr. Linh's son) carrying his younger brother, traveling in the same direction ahead.
The collision injured N., who was taken to the emergency room by relatives. The two sides later reached a civil agreement, and Mr. Linh refused to assess the injuries. "At the time of the acciden.t, N. was in 3rd grade. My son was in a coma for more than 8 months, and was transferred to 4 hospitals for treatment at a cost of nearly 1 billion VND, but H.'s family, apart from providing more than 40 million VND in support, did not ask about him once," Mr. Linh informed.
On July 5, 2024, Mr. Linh filed a complaint, requesting an assessment of his son's injuries. A month later, Chau Thanh District Police issued a decision to request an assessment.
According to the forensic examination conclusion of Soc Trang Province Forensic Center, N. suffered 90% permanent physical damage. The traffic acciden.t caused N. to suffer a severe traumatic brain injury, requiring continuous treatment for more than 13 months at many end-line hospitals in Ho Chi Minh City, undergoing 7 surgeries to fight for her life.
"Now that he's home, N. can't walk by himself. Whenever he hears a loud noise, he panics and cries. No one can touch him. Many nights he holds his head and struggles. My family is now exhausted both mentally and physically," said Mr. Linh.
The case was then transferred to the District Police Investigation Agency for handling according to its authority. On February 12, the District Police Investigation Agency decided not to prosecute the case. The results of the investigation and verification showed that H.'s behavior showed signs of the crime of "Violating regulations on road traffic participation". However, at the time of committing the crime, H. was not old enough to be held criminally responsible (only 14 years, 10 months and 12 days old).
During this time, Mr. Linh submitted petitions to many authorities but was not satisfactorily resolved, so he filed a lawsuit. Judge Nguyen Thi Nhien said that the court accepted the case in January 2024 but it was delayed because the plaintiff filed an additional lawsuit, requesting an assessment of N's physical injuries.
According to Ms. Nhien, after the decision not to prosecute by the Investigation Police Agency, the court continued to handle the case. However, Mr. Linh did not provide enough evidence and requested a postponement, so the court postponed the meeting.
At the meeting, Mr. Linh and his wife brought bab.y N. early. The image of the father carrying his son up the stairs to the mediation room on the 2nd floor made everyone present feel sorry.
Ms. Lam Thi Lan (Mr. Linh's wife) said: "My chil.d's life is considered disabled for life. He cannot walk or take care of his personal hygiene and needs help. We have sold all the property in the house to pay for his medicine."
To have hundreds of millions of dong to pay for treatment to save their son's life, Linh and his wife's assets were almost exhausted, they had to borrow mone.y everywhere, even taking out a quick loan of 200 million dong.
"My eldest son is only 14 years old, and after finishing 5th grade, he had to drop out of school to stay home and look after his younger brother. My wife found a job to work from home, mainly weaving baskets, earning 50-60 thousand VND per day. I work as a construction worker, and my income is also unstable. There were times when we were so desperate that the whole family had to close down to avoid debt," Linh confided.
