The incident of a Mercedes crashing into 10 motorbikes in Thu Duc City has caused a stir in public opinion in recent days. The police said the female driver was Ms. N (41 years old, residing in Thu Duc City, Ho Chi Minh City).
While traveling on the parallel road of Vo Nguyen Giap, from Rach Chiec bridge to Suoi Tien, at the Thu Duc intersection, Ms. N slowed down and suddenly rushed forward, knocking away the motorbikes in front. As a result, 10 motorbikes were hit by Ms. N, one of which was dragged under the car for about 50 meters. The victims were immediately taken to the emergency room, including one who died on March 17, Ms. T (28 years old, from Dong Nai).
Initial test results showed that Ms. N was driving under the influence of alcohol, entered the motorbike lane, and could not control her speed, leading to the collision. At the police station, the female driver cried and confessed that she had a sad family situation, which led to negative thoughts. Before the series of motorbike crashes, Ms. NTTN drank alcohol, then held a pre-written letter with many negative contents, drove to Phuc An Vien cemetery to talk to her deceased father, and on the way back, the collision occurred. While driving, Ms. TN confessed that she stepped on the brake pedal but mistakenly stepped on the accelerator.
This woman is currently being detained at the Ho Chi Minh City Police Department to investigate her violation of road traffic regulations. What the public is concerned about is how Ms. N will be held responsible before the law for the above serious circumstances and consequences?
Referring to this incident on March 17, lawyer Nguyen Anh Thom (Hanoi City Bar Association) emphasized: "Human life and health are the most important things. Any illegal acts of violating the life and health of others will be strictly handled."
According to lawyer Nguyen Anh Thom, initially, the car driver violated the Law on Road Traffic Order and Safety in 2024 as follows:
Driving a vehicle on the road with a breath alcohol concentration of 0.4 mg/liter, violating Clause 2, Article 9 of the Law on Road Traffic Order and Safety 2024.
Violation of the general rule according to Clause 1, Article 10 of the Law on Road Traffic Order and Safety 2024 "Road traffic participants must drive on the right side in the direction of travel, in the correct lane and prescribed road section, comply with road signs and other road traffic rules".
Failure to comply with traffic light signals, violating Point b, Clause 2, Article 11 of the Law on Road Traffic Order and Safety 2024.
"With the consequence of killin.g one person and injuring many others, the driver showed signs of committing the crime of "Violating traffic regulations" according to Clause 2, Article 260 of the Penal Code (CPC).
Regarding the fact that the authorities also found a letter written by the female driver with negative content, lawyer Nguyen Anh Thom said that it is necessary to consider the subjective consciousness of the driver to determine whether the act of driving a car into vehicles stopped at a red light was intentional to resolve personal negativity or was due to the influence of stimulants leading to not being able to control the behavior (unintentionally) causing the incident.
"If the investigation results determine that the driver intentionally crashed into vehicles stopped at a red light, causing one deat.h, many injuries, and damage to other people's property due to negative psychology and personal frustration, although not wanting to take the life of another person but ignoring the consequences, there will be signs of attacking another person according to the provisions of Clause 1, Article 123 of the Penal Code," lawyer Nguyen Thanh Thom analyzed.
In addition, if the result of the property valuation of the damaged motorbike is from 2,000,000 VND or more, the driver will also be held criminally responsible for the crime of "Intentionally damaging property" as prescribed in Article 178.
