In court, Judge Tsuyoshi Momosaki charged the murderer and said: "We can imagine the excruciating pain of having a 9-year-old girl's life taken away like this. According to the high court's ruling in the criminal trial, Shibuya kidnapped Linh when the girl (then 9 years old, in 3rd grade), was on her way to school. Two days after going missing, Nhat Linh's body was found. The Chiba District Court later sentenced Shibuya to life in prison because his DNA was found on the victim's body, while the DNA identified from the blood on Shibuya's car matched that of Nhat Linh.
The Chiba District Court had previously convicted Shibuya, but at that time he insisted on pleading not guilty to life in prison. The Tokyo High Court upheld the ruling in March this year, rejecting an appeal by prosecutors and defense lawyers. Previously, it is known that the defense group had requested an acquittal of Shibuya, while the prosecution requested the maximum execution of the sentence.
Previously, NHK reported that Nhat Linh's family had no chance to appeal, the case was officially closed. The Tokyo prosecutor previously decided not to ask the Supreme Court to review the verdict in the case of Nhat Linh who was murdered in Chiba Prefecture. Defendant Shibuya Yasumasa received a life sentence at the Tokyo appellate court. At the time after the sentence was announced, the victim's family expressed their desire to continue the appeal, wanting the perpetrator to receive the maximum sentence. However, according to the victim's family lawyer, the Tokyo prosecutor said they did not find any circumstances or reason to proceed with the appeal to the supreme court.
"We have thoroughly reviewed everything, the decision not to appeal is because we could not find a legitimate reason to do so," said Motonobu Hisagi, deputy prosecutor at the Tokyo Public Prosecutor's Office. Under current rules, a defendant will not be able to receive a punishment heavier than that imposed by the high court if prosecutors do not appeal. This means that defendant Shibuya will not receive the highest sentence and the battle for justice of Nhat Linh's family for the past few years has not achieved the desired results. Le Anh Hao, Nhat Linh's father, said that now he doesn't know what to do for his daughter. He added that the family's struggle in court over the past few years has become meaningless. On Nguyen Thi Nguyen's personal page, Nhat Linh's mother also officially confirmed that they could not continue to appeal. The mother apologized to her late daughter for not being able to continue fighting. Ms. Nguyen also expressed her longing for her ill-fated daughter and said that the whole family will continue to fulfill Nhat Linh's unfinished dream and maintain the will to fight to join the society "to raise their voice against the except for the problem of physical abuse and the taking of children's lives at all times."
