The trial of defendant Truong Van Minh, who beat student Nguyen Hoang Dat to death, was reopened at the Long Bien District People's Court. This case has attracted public attention regarding school violence and the compensation for the deceased student's family.
To assist in the trial, the court also summoned an expert and an investigator from the Long Bien District Police. In addition, the court also summoned Mr. Tam (45 years old, Minh's father) as his guardian. Mr. Tam's remaining son, Khang, 11 years old, was also among the people involved summoned by the court.
As the representative of Nguyen Hoang Dat (a 13-year-old eighth grader who passed away), Dat's mother brought her son's portrait to the court, expressing her indescribable grief. The incident attracted public attention, so security inside and outside the courthouse was tightened. Police blocked the roads from a distance, and anyone entering or leaving had to have identification.
The incident occurred when defendant Truong Van Minh, 15 years old, acted violently towards his classmate Nguyen Hoang Dat in a minor conflict. Minh and Dat both attended the same school and were friends. However, when Dat asked Khang, Minh's younger brother, to beat up another student, the situation became tense. Minh intervened, slapping Dat in the face, causing Dat to fall to the ground and hit his head on the stone floor, causing a brain hemorrhage. Dat was then taken to the hospital in an unconscious state and eventually died of brain trauma.
Dat's family believes that Minh's actions were not simply school violence but also a "showing off" attitude after committing the crime, as Minh texted his friends without showing any remorse.
At the trial, Dat's family requested compensation of 1 billion VND and changed the charge of "Intentionally causing injury" against Truong Van Minh. At the same time, they also requested that Mr. Tam (Minh's father) be prosecuted as an accomplice for failing to prevent his son's actions.
Meanwhile, Mr. Tam burst into tears, apologized to Dat's family and admitted his part of the fault for not intervening in time. He said: "If I had told my son to stay home, this might not have happened."
Regarding Mr. Tam's behavior, the investigation agency determined that his son's beating and injuring Dat was beyond his subjective consciousness. Witnessing Minh beating Dat, Mr. Tam ran to stop him. Tam's account is consistent with the accounts of those present at the scene and other evidence in the case file. Therefore, Mr. Tam is not an accomplice with Truong Van Minh in the act of "Intentionally causing injury".
The case is currently under investigation and trial by the authorities. Truong Van Minh faces a sentence of 7 to 14 years in prison for "Intentionally causing injury". However, the victim's family has requested a higher sentence and requested a deeper investigation into Minh's father's role in the incident. The criminal prosecution of the individuals involved is still controversial.
As for Truong Van Khang, the prosecution agency considered him an accomplice of Truong Van Minh. However, at the time of committing the crime, Khang was 11 years, 5 months and 20 days old, not old enough to bear criminal responsibility.
The case not only caused heartache for Datâs family but also highlighted the problems of school violence and the lack of effective preventive measures in the school environment. Many opinions say that school violence needs to be dealt with more severely, legal measures need to be enhanced to protect the safety of children and avoid heartbreaking incidents like this from happening.
