Stir up a car with wheels on a motorcycle running on Ca Mau street, explaining the cause

On October 31, according to information from the People's Committee of Dam Doi district (Ca Mau province), the authorities are clarifying the image of a car moving on the road with wheels that resemble motorcycle wheels.

Earlier on October 30, a social networking site posted the content "The road to Dam Doi is now a bit strange", accompanied by a clip of about 20 seconds recording the image of a car moving on the road with a rear wheel that looks like a motorcycle wheel.

The clip has received many comments from the online community saying that this is unsafe when cars move on the road, endangering the people in the car and other road users. Leaders of the Ca Mau Provincial Traffic Safety Board have asked the authorities to clarify.

Through local verification, the car in Mr. V.'s clip (living in Dam Doi town), about 5 days ago, had a broken right rear axle. On the morning of October 28, Mr. V. contacted a garage in the district to tow the car for repair. However, because the rear axle of the car was broken, the spare wheel could not be installed, so the garage worker temporarily welded a motorcycle wheel to tow the car to the workshop. On the way to drag the car to the factory (more than 1km), someone came back and posted it on social networks.

Contacting the owner of the clip, Mr. Duy, the owner of a studio in Ca Mau, said that he was the one who recorded the clip because he found it strange. He posted it on Facebook because he wanted more people to know and also warned people about the level of safety, according to Tuoi Tre.

Information from Dan Tri, looking at the incident from a legal perspective, lawyer Quach Thanh Luc, Director of Rule of Law Firm, Hanoi Bar Association, said that motor transport is identified as a source of extreme danger. Owners of sources of extreme danger must operate, use, preserve, look after and transport sources of extreme danger in accordance with law.

The manufacture, assembly, renovation, repair, maintenance and import of motor vehicles participating in road traffic must comply with regulations on quality, technical safety and environmental protection. Arbitrarily changing the structure of the vehicle owner, making the vehicle unsafe when operating, affecting the safety of road users.

Lawyer Luc cited Clause 1, Clause 2, Article 55 of the Law on Road Traffic 2008 stipulating:

"1. The manufacture, assembly, renovation, repair, maintenance and import of motor vehicles participating in road traffic must comply with regulations on quality, technical safety and environmental protection. Other cars must not be converted into passenger cars.

2. Vehicle owners must not change the structure, components and systems of the vehicle by themselves that are not in accordance with the manufacturer's design or the renovation design approved by the competent agency."

In addition, at Point a, Clause 9, Article 30 of Decree No. 100/2019/ND-CP dated 30/12/2019 stipulating penalties for administrative violations in the field of road and railway traffic (amended by Point i, Clause 17, Article 2 of Decree 123/2021/ND-CP dated 28/12/2021), it is stipulated as follows:

"9. A fine of between VND 6,000,000 and VND 8,000,000 shall be imposed on individuals, and between VND 12,000,000 and VND 16,000,000 shall be imposed on organizations that are owners of automobiles, tractors, special-use vehicles and vehicles similar to automobiles that commit one of the following acts of violation:

a) Arbitrarily changing the frame assembly, engine assembly (engine), brake system, transmission system (power transmission), movement system or arbitrarily modifying the structure, shape and size of the vehicle not in accordance with the manufacturer's design or the design in the dossier submitted to the vehicle registration agency or the renovation design approved by a competent agency; arbitrarily changing the use features of the vehicle or arbitrarily installing additional mechanisms for lifting and lowering the trunk and lifting of containers on the vehicle (including trailers and semi-trailers)".

Compared with the provisions of the law, the act of arbitrarily renovating the structure, shape and size of a car is a violation of the law. This act will be fined from 6,000,000 VND to 8,000,000 VND for individuals, from 12,000,000 VND to 16,000,000 VND for organizations that are car owners.
