TikToker Mr. Pips is currently facing multiple charges. The case has caused a stir because of its scale and the tens of thousands of people affected. The most important issue in the current case is the sentence Mr. Pips may face.
On December 6, the Hanoi People's Procuracy is coordinating with the Hanoi Police to continue to expand the investigation into the banner ring that is currently rampant on the internet. Currently, the total assets seized and frozen by the authorities are estimated at over VND5,000 billion.
Accordingly, the authorities have decided to prosecute the case and prosecute Pho Duc Nam (aka Tiktoker Mr Pips); Le Khac Ngo (born in 1990) and 24 other defendants for crimes under the provisions of Article 174, Article 390 and Article 324 of the Penal Code.
According to Article 174 of the Penal Code, the crime of property appropriation carries a penalty of 6 months to 20 years in prison or life imprisonment, depending on the amount of money appropriated. In particular, if the value of the property appropriated is 500 million VND or more, the penalty can be from 12 to 20 years in prison or life imprisonment. In addition, the defendants involved in the case were also prosecuted for other crimes such as money laundering and failure to report a crime, with severe penalties.
Mr. Pips is accused of being the leader or an accomplice in this large-scale canvas ring. The investigation agency said that the total amount of money embezzled was more than 5,000 billion VND, a huge number. To date, 18 victims have reported with a total amount of embezzled money of 28 billion VND, most of whom are workers and students with no knowledge of securities and this number may increase.
Information about Mr. Pips' aggravating (such as recidivism, organized crime) or mitigating (such as honesty, repentance) circumstances is still being considered during the investigation. These factors may affect the sentence he receives.
Conducting urgent searches of the subjects' residences and workplaces, the Investigation Agency seized and frozen the subjects' assets worth a total of more than 5,000 billion VND, including: 127 billion VND in cash, savings books worth about 306 billion VND, 216 kg of gold, 128 real estates, 30 cars of various types, frozen 9 billion VND in bonds and many other valuable assets.
According to investigation documents, Pho Duc Nam colluded with Le Khac Ngo to set up a property appropriation ring, following the model of stock brokerage companies. Tiktoker Mr Pips (Pho Duc Nam) is famous for his videos posting about his lavish lifestyle and teaching how to make money, with hundreds of thousands of followers on Tiktok and Youtube.
The subjects in this banner ring used many sophisticated tricks to attract participants. They often posted pictures and videos showing off their rich and luxurious lives on social networks to build trust.
They then approach participants through social media channels, advising them to invest in virtual exchanges, promising high profits. When customers lose money in transactions, even losing all the money in their accounts, the subjects provide false information so that customers continue to have faith, transfer more money to "recover".
When the customer is no longer financially capable, the subjects block communication, appropriate all the money the customer has transferred and block communication.
The case is still under investigation and trial. The police have prosecuted more suspects and frozen assets related to this case. The official trial is expected to take place in the near future. Based on legal factors, if found to be the mastermind, Mr. Pips could face a maximum sentence of life in prison. However, the final sentence will be decided by the court after the trial.
